Expert's Assistant chat
Customer: Second opinion] Hello My mom who has Demetia owns a triplex. The house is in dire need of renovation. We are starting with the roof. Her son lives with her. He has been there for 15 years due his divorce and loss of custody of his daughter, never worked just leeching off my parents. My father just passed away. The house in in my mothers name only. My sister and I have a mandate of incapacity to take care of all her financial and health needs. We just informed her son that someone is coming to estimate the roof. He wrote back that my sister is harassing and he will be calling the police. We need to fix the roof asap b4 winter how do we do this?
JA: What state are they in? It matters because laws vary by location.
Customer: Montreal, Canada, province of Quebec
JA: What steps have they taken so far?
Customer: Months ago we had brought in contractors to check for asbestos and we ended with 4 hours of police intervention he would not let anyone in. My sister sent him a text advising him that today the estimator for the roof will be coming to give us a quote. He refused but the estimator still went on the roof. obviously her son was not there. he sent pictures of cables and pipes that were on the roof. he found it very bizarre.
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: so appreciate this.

Please note that I am working from my computer and not actually texting. If you don’t answer back for a while I may not be online when you do but I will never desert you and will check back often. As well, as I am working from home it is possible that I will be interrupted but I will always return back as soon as I can.

Finally, although the site offers a call option I personally do not take calls but just work online. Some find this confusing as it looks like the offer is coming from me but that is just how the site presents the offer and it really isn’t coming from me. Some of the other experts do take calls and so you are very welcome to request a call on this post and an expert may take it. They will have the benefit of reading our exchange which should work out very well for everyone involved!

Does this son pay rent?

Does he live in his own unit or with your mother?

Your mother and this now means you, can have him move out.  He has no right to remain when you tell him to leave.

That is the way to stop this.

If he won't leave on his own ( and I am sure he will not) you can get a court order.

Your best next step would be to have a lawyer in Montreal send him a letter demanding he leave and threatening court.

What you can do to find a lawyer is one of the following things.

You can review the law society's suggestions on how to find a lawyer. Depending on where you live you may be able to consult with a lawyer for $25 for the first half hour:

https://www.barreau.qc.ca/en/find-lawyer/

Or you can check on a site called lexpert. This is a legal directory of leading lawyers and law firms throughout Canada and is well-respected by the legal community.
Here's the link to their website:

http://www.lexpert.ca/directory/find-lawyers-or-law-firms/

Does that help as a starting point?

Customer
I wish it could be so easy. But sometimes we have to put our big pants on and just deal with him. He has been like this all our lives whereas my dad who just passed away kept us away from him and his toxic behavior. Now we are left to deal with him head on. I thank you for your guidance and appreciate your direction. We have no choice since he is who he is and never attempted to change he leaves us no choice. Thank you again.
