Customer: Hello. I live in Edmonton, Alberta. I purchased a new holiday trailer in February. The trailer needed to be manufactured and delivered when ready. The dealer provided an Offer to Purchase listing the details of the trailer to be purchased, the price ($29,900.00+GST) and the deposit ($1,500.00) that was paid by credit card. The Offer to Purchase was signed and returned to the dealer. I received a call from the dealer today saying that the manufacturer had raised their prices and that they were going to have to pass the increase onto me - an increase of $4,800.00. I believe I have a contract for the original price with the dealer that they have to honour. Am I correct in this assuption?

Customer: This is Alberta, Canada. This is an RV and is new.
JA: Have you contacted the seller or manufacturer?
Customer: Ye, I have spoken with the seller - an RV dealership in Alberta. The manufacturer is Forest River - an American Company.

Unless there's some conditional clause in your contract, the dealer cannot change the price merely because the manufacturer has raised their prices.

you negotiated the terms, signed the contract, paid the deposit.  You have the right to enforce the contract price as signed.

Hi Alvin. Following up on my previous question about the RV dealership increasing the price of the trailer I bought by $4,800.00. I talked with the sales manager yesterday. Their "Offer to Purchase" does have a conditional clause: "the Dealer has the right to cancel any sales agreement by returning the form of deposit or downpayment." and "This order is subject to contingencies, fires, strikes or other causes beyond the control of the vendor." However, the Offer to Purchase was initially scanned and sent to me for signature, and the fine print containing these clauses was not included so I was never able to see or read them. Does that have any bearing on this case? Is it worth pursuing with a lawyer?
