Expert's Assistant chat
Customer: I am currently staying in an apartment... been staying here for close to 3 years. The apartment is currently infested with cockroaches and i have been trying to get them to adress that for about 20 days. I made the decision to move out. When i realised this place is not safe for my baby. Boarldwalk is agree for me to break my lease without penalty . But they are insisting i pay for the whole of August. Despite the fact that i will be moving out latest by August 8. Wanted to know what my legal option is
JA: Because laws vary from place to place, can you tell me what state the property is in?
Customer: Calgary
JA: What are the terms of the lease? Any issues related to maintenance or upkeep?
Customer: The lease is till December 25. But they are allowing me to break it early due to the fact that the whole building is infested with Cockroaches and they have not been able to solve that problem
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: Thats all. My question is simply do i have any legal standing to move out immediately and not have to pay for the whole of August. I a. Ready ti pay for the days i stayed

You do not have legal standing to move out immediately and not have to pay for the whole of august.

You technically are bound by the lease, and your remedy with regards ***** ***** cockroaches is to apply to the board to force the landlord to remedy the bug issue. Here, the landlord is letting you out of your lease by agreement.

Customer
Hi. So my 2 option is to stay with the coakroaches till they can finally remedy it or move out and pay for the whole of August

Basically yes. You may also be eligible for compensation for the landlord's delay in fixing the problem.

Customer
i guess delay in fixing the issue is subjective right. So there is no way to know how long a delay qualifies for comoensation?

Correct, your damages must also be reasonable. If you need to move somewhere else or if you suffered any adverse health side effects.

Customer
Thanks for your help
