Customer: My name is ***** ***** and working in a hotel on housekeeping since september 2013.
I got laid off last march 21,2020 and started recieving CRB/E.I.I was recalled last July,2020 but I had a medical ilness as my doctor submits doctor's note every month until march 2021.When Im ready to work my doctor send fit to work notice to my employer on april 9.My employer called and told me the business is slow.They want me to wait for a recall notice maybe by fall.E.I.told me to look for another job, while waiting to be recalled from my employer.Can I get my severance pay while looking for a job from other company?What are my options?

Hi, sorry to hear about the lay off.  Yes you can claim constructive dismissal and demand termination pay from your employer.  The employment standards act may permit an employer to temporarily lay off an employee, however, unless your Employment Agreement provides for a lay off you maintain the right to sue for constructive or wrongful dismissal if laid off in these circumstances.
