Hello, thank you for choosing Just Answer.  My name is ***** ***** I am happy to be assiting you with your question today.

Customer
hi

KAVITAR39, Expert

Before we start, please be advised that this discussion is for providing general information only, it is not detailed or specific legal advice, and it is only for the purpose of helping you understand the nature of your situation from a legal standpoint and to discuss options. You are not hiring me to be your lawyer nor does our discussion constitute a Solicitor-Client relationship.  Moving forward, you should retain a lawyer in your local area if you wish to take any legal action.

Please note that I am working from my computer and I will respond to you as quickly as I can but please do not be concerned if you do not get an immediate response as I may not be online at the time. Rest assured I will do everything that I can to answer your question.

Further, please note that the website may offer you an option of a 'premium service' by way of a phone-call. This prompt is not being sent by me and is an automatic website feature. I am happy to chat with you on the phone or over chat, so don't feel obligated to accept the phone call prompt but some conversations and topics are much easier discussed over the phone rather than by typing. If you would like a phone call, please chat with me first so we can determine that I am a suitable person to chat with you and then we can schedule the phone call.

If you attempt to respond to me by texting on your phone, please note that I will likely not receive that message as the platform requires the conversations to take place on here. So, if you have sent me something and I haven't responded in more than 24 hours, it is likely that I never got that message

Can you please tell me what legal information you wish to find out?

Customer
Hi
Customer
I am seeking advise for divorce
Customer
i am legally married. I am citizen and my wife is a PR
Customer
I am currently Citizen
Customer
I was on PR when I got married and sponsored my wife PR
Customer
we are from India
img

KAVITAR39, Expert

How long ago did you sponsor your wife? When was she issued her PR status?

Customer
i got married in the year 2016 dec
Customer
she got her 2018
Customer
she came to Canada on Feb 2018
Customer
around 10 months
Customer
we are now separated and she went back to Dubai and is living with her parents
Customer
she left last year November
img

KAVITAR39, Expert

Okay, I think I missed something in between, what happened in 10 months?

Customer
no i mean it took 10 months for her pr to be approved
Customer
since 2018 feb she lived with me
img

KAVITAR39, Expert

Oh Okay, understood.

So you have been separated for approximately 7 months now, correct?

Customer
considering November 2020
Customer
we dont have kids and property
img

KAVITAR39, Expert

Is your spouse seeking spousal support ?

Customer
we havent discussed that yet. We may go for mutual divorce in 95% of the case
Customer
or I am not sure if she will respond if send notice
Customer
two scenarios
Customer
if it is mutual we will agree on spousal support
Customer
wat are things considered here
img

KAVITAR39, Expert

Firstly - a Judge will not issue a Divorce Order until the parties have been separated for 12 months. If there are no other claims ( property/Support etc.) then you are most likely filing a Simple Divorce Application.

If this is going to be a Divorce on Consent, then you can file what is called a Joint Simple Divorce.  Both parties will sign the required forms which can be filed online and the fees paid online as well.

OR

You can file the Simple Divorce Application and have her personally served at her Parents' home in Dubai.  She will have 60 days to respond.  If no response from her in the 60 days, you can then proceed to file your Affidavit for a Divorce  with your draft Divorce Orders .

img

KAVITAR39, Expert

Does that help as a starting point?

Customer
joint simple divorce, what are the things considered
Customer
for spousal support
Customer
does the notice go as physical paper or email
Customer
she is used to work on and off in Canada
Customer
due to covid, since call centers are not working
Customer
she was not working and she left
img

KAVITAR39, Expert

Spousal Support is based on several factors: length of marriage, dependency, lifestyle, income of both parties.

Customer
i am getting a annual package 95000 per year (before tax)
img

KAVITAR39, Expert

Customer
length of marriage will be 2016 or 2018
Customer
2016 dec we got married
img

KAVITAR39, Expert

I can provide you a link to a Spousal Support calculator, would that be helful to you?

Customer
sure
Customer
one more question
Customer
she was saying she wants to come back and after getting job move to a new place
Customer
she can get citizenship
img

KAVITAR39, Expert

Support Calculator. Make sure you select spousal Support only okay.

Customer
does that mean 7 months since she left will be reset
Customer
to 0
img

KAVITAR39, Expert

The separation date only changes IF you reconcile for more than 90 days.  So if she retirns and you get back togehter for more than 3 months, then the date will reset.

Customer
does separated for a years means living in same place or its just matrimonial relationship
Customer
if reset occurs again 12 months
img

KAVITAR39, Expert

Date of Separation means the date you BOTH realize that your marriage is not working and you want to live separate lives.  You can be separated but still living in the same property, just not sharing a bed etc.

Yes, It is always 12 months of separation before a Divorce Order can be granted.

Customer
does a couple living in same apt but not living as a couple get divorce
img

KAVITAR39, Expert

Yes, as I mentioned above, you can live in the same property, but not be sharing a bed or have any sort of realtionship with each other.

Customer
how can i prove that i sleep in bed room and she sleep in main hall
Customer
does the judge take word of mouth
Customer
the calculator says marriage or cohabbitation
Customer
i should select 2016 dec
Customer
or feb 2018
img

KAVITAR39, Expert

It will not be an issue unless your spouse contests.  For a simple Divorce it is very rare that the Parties will appear before a Judge. The application is reviewed by a Judge in Chambers and Orders mailed out the the parites/their lawyers.

Customer
when we really physically lived together
img

KAVITAR39, Expert

Date of Marriage. Cohabitation will be if you were living together prior to marriage OR if you were in a common law relationship.

Customer
oh no since she was in India
Customer
ok technically i have to say 2016 dec
Customer
but living happend 2018 feb
Customer
i must put 2016 dec right
img

KAVITAR39, Expert

Spousal support is usually a range provided, for shorter marraiges, it's usually on the lower end of the range.

img

KAVITAR39, Expert

Yes, use the 2016 date.

Customer
since she is young and qualified and has worked in the country, so when market is good she may get a job
Customer
how far the spousal support goes
Customer
will it stop if she marries someone else
img

KAVITAR39, Expert

Yes, those are used as discussion points for Spousal Support negotiations.

Once you retain a lawyer, they will be able to review your financials and your spouse's credentials and assist you with making a better determination on Spousal Support.

Customer
ok
Customer
the question is reset
Customer
if she comes , with 3 months she has to move
img

KAVITAR39, Expert

Yes, if she remarries, the general rule of thumb is that she will no longer qualify for Spousal support unless there are exceptional circumstances.

img

KAVITAR39, Expert

The 3 months/90 days is if you both reconcile.  That is, you resume your marriage . Only then there will be a reset.

Customer
what if she goes to Dubai and lives with her parents
Customer
then wat about spousal support
Customer
if she plans not to work and remarry
Customer
then
img

KAVITAR39, Expert

Your marriage was not long, so Spousal Support will not be indefinitely. IF  there is a claim for Spousal Support, there is also the option to pay a 1 off lumpsum payment - so you do not have to pay monthly .

Customer
then i wont also not know whether she will or not right
img

KAVITAR39, Expert

Are you sure she will make a claim for spousal support?

Customer
99% no
Customer
her father is ok for mutual and has not spoken about support
Customer
lunpsum mean millions
Customer
i am not rich
img

KAVITAR39, Expert

Okay, so then discuss the Joint Divorce Application with her and see how that goes .

Customer
just an IT professional
Customer
considering Canadian standards bottom of the pyramid
Customer
i dont even own anything
Customer
car is on loan and apt is rented
Customer
thats all
img

KAVITAR39, Expert

No no. lumpsum means, based on the calculations, you can agree to a figure to pay on a 1 off basis, instead of monthly.  It is an option - not mandatory..

img

KAVITAR39, Expert

Will it be easier for you to discuss this on the phone?  Or are you comforatble with chatting here?  The phone call is an additonal cost though.

Customer
ok we can send the notice only after a year
Customer
right
Customer
on call sure
Customer
send me the link i will pay
img

KAVITAR39, Expert

You can get all your documents together now and file it.  It is just that the Judge will not issue an Order until the 12 months has passed.  Or you can wait the 12 months and then file, just incase you reconcile.

img

KAVITAR39, Expert

You need to choose the option of Premium Service, telephone call.

Customer
hello
Customer
oh you mean we can file now
img

KAVITAR39, Expert

Hi, I am here.

Customer
wait for the judge
img

KAVITAR39, Expert

Yes, you can.

Customer

img

KAVITAR39, Expert

Oh, so sorry to hear that.

img

KAVITAR39, Expert

Have I answered all of your questions today?

Customer

Customer
only questions what all things i must do to file
Customer

Customer
or approximately
img

KAVITAR39, Expert

Since you are in Ontario, please contact the Law Society of Ontario and use their Lawyer Referral Service. You will be given a lawyer to contact and arrange a free 30 minute consultation. The website for the LSO Referral is : https://lsrs.lso.ca/lsrs/redefineLocale.action?currentLang=en

Another option available to you is the use of the website: lexpert. It is a directory of expert lawyers throughout Canada . Here's the link to their website: http://www.lexpert.ca/directory/find-lawyers-or-law-firms/

Customer
can i ask one more question may be it is premature to ask now
img

KAVITAR39, Expert

Prices vary from Lawyer to Lawyer, some offer block fees for Simple Divorce Applications instread of a hourly fee.

Customer
after judge approves and gives divorce how much months i have to wait for a second marriage and spouse sponsorship
img

KAVITAR39, Expert

Sure, ask and I will my best to answer for you.

Customer
technically how much gap i need to wait
img

KAVITAR39, Expert

Once you have your Divorce Certificate ( issued 30 days after the date of your Divorce Order), you can then remarry.

As for Spousal Sponsorship, that will be dependant on the terms/conditions attached to your current sponsorship.. Remember, Divorce does not stop your obligation to be finacncially responsible for your current spouse.

Customer
for e.g if i find another person while my divorce is going
img

KAVITAR39, Expert

You will need to discuss the Spousal Sponsorship gap with an Immgiration lawyer as they will need to review the terms i noted above reagarding your current spouse.

Customer
thanks
Customer
i need to decide whether to start now
Customer
file now
Customer
or wait till November and file
img

KAVITAR39, Expert

Exactly.

Customer
how long will it normally take for the judge to issue divorce
Customer
will it take more than a year
Customer
in India, it takes around 4 to 7 years
Customer
in some cases
Customer
what is the avg time
Customer
here in Canada
img

KAVITAR39, Expert

Varies on the Court.  Sometimes it can take 3 months, sometimes more or less.  It's all dependent on how busy that particualr Court is.  I have never had an application take over 1 year though.

Customer
one more question pls mam
Customer
if i file the notice this year november
img

KAVITAR39, Expert

Sure.

Customer
notice went to her address in Dubai
Customer
she says i need to come and live to move to a diff place
Customer
will that create trouble
Customer
technically to my application
Customer
like few months she stays and find job and move out
Customer
those few months although we are not having any relationship but sharing same apt
Customer
like a roof
img

KAVITAR39, Expert

If you are still separated and not resuming your marriage, then there should be no issue.

Customer
ok separated as if in mind not separated literally
Customer
only if she object that causes trouble
img

KAVITAR39, Expert

Separated in mind and body . You both have to be on the same page that your marriage has ended.

Customer

Customer
