Customer: Hi, I am a student at the University of Calgary and applied as a conventional refugee from within Canada a few months back. I was waiting on my interview date but as an emergency had to leave due to the declining health of my mother. I came to the United Arab Emirates on a one-month visa and am seeking refugee from my home country Pakistan. Yesterday I had a flight back to Canada to which I was denied boarding. I cant stay in the U.A.E for much longer as I extended my visit visa for another 2 months but will be deported back to Pakistan shortly after. I am confused and desperate to what I can do next
JA: What confuses you?
Customer: At the border I was denied entry but was not really told how I could come back and what the process would be like as I applied from within Canada but am not in Canada anymore
JA: What steps have you taken? Have you filed any paperwork with the U.S. government?
Customer: Why would I need to file paperwork with the U.S government as I am currently in the United Arab Emirates and am seeing a way back into Canada (legally)? I have contacted the IRCC to ask for what steps I should take next but haven't gotten a response yet
JA: Have you talked to a lawyer about the visa?
Customer: No, I have not yet but am looking into doing so. My Visa has not expired yet but apparently the immigration officer said that I could not use it to come back
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: No this is all the information until now that I know of since I haven't received anything else from the IRCC after contacting them

I am sorry to hear of this difficult situation.

You were denied entry because you can't enter Canada as a visitor or a student on a temporary study permit with the intention of remaining so you declared refugee status and left because you had to but now your record shows that your intention is to remain in Canada so they can't let you in on a visitor's visa or a study permit.

Do you see what I mean?

I do, this is what the immigration officer told me on the phone when I was denied boarding at the gate. What I am trying to figure out is how to follow through my refugee application from outside of Canada. Can I still do that if I applied within Canada and left due to an emergency?

No. I don't think you can. I think you are in a very difficult and possibly impossible situation. I am so sorry this happened to you but I can't think of a way out.

If possible retain an immigration lawyer in BC. Perhaps they can do some thing but I honestly don't know what.
