Customer: I lived in Ontario and have now moved to Calgary, I am having an issue with the moving company that we used.
JA: Have you talked to an Ontario lawyer about this?
Customer: No, because of the issue with this company, I don't know what lawyer I can trust..nothing personal against the lawyer
JA: The Lawyer will be able to walk you through that. What steps have you taken so far?
Customer: In what way..
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: Yes let me explain what happened...I contacted a company through homestars - Getmovers - I explained in detail the move that was required. They sent me an approx quote on the cost of the move 6000 lbs @$1.10 per lb. On the day of the move after the movers had packed my sons apt up and half of our home, the owner of Ontario van Lines came to our house and said that the cost could/would exceed $19,000.00, At the end of the day, after the movers moved most of our stuff into our new home, he gave me a bill for $33,000.00. I had a discussion with the owner asking him why from the quote to the delivery of our items the cost was 4 times the amount. I have paid them so far $1,200.00 depost by credit card, $10,000.00 and $5,900.00 by interac transfer to the moving company. He expects us to pay the balance by this coming Thursday.

Debra, Expert

Hello and Welcome to JustAnswer. My name is***** will be working on your question today and I am looking forward to our conversation.

Debra, Expert

Please note that I am working from my computer and not actually texting. If you don’t answer back for a while I may not be online when you do but I will never desert you and will check back often. As well, as I am working from home it is possible that I will be interrupted but I will always return back as soon as I can.

Finally, although the site offers a call option I personally do not take calls but just work online. Some find this confusing as it looks like the offer is coming from me but that is just how the site presents the offer and it really isn’t coming from me. Some of the other experts do take calls and so you are very welcome to request a call on this post and an expert may take it. They will have the benefit of reading our exchange which should work out very well for everyone involved!

I know your question is important to you and I will be giving it the time and attention it deserves.

I am sorry to hear of this difficult situation.

Do you already have your things? What is the explanation for them charging twice as much as they quoted?

What is your contract in writing?

Customer
I had a real estate lawyer over for dinner yesterday, and he reviewed everything that I had and he says there is no contract signed
img

Debra, Expert

Does he mean that there is a written estimate but no actual agreement?

You seem to have missed all of my questions. Here they are again:

Do you already have your things? What is the explanation for them charging twice as much as they quoted?

What is your contract in writing?

Customer
What is your email I will forward you the original quote, and then take pictures of the other paperwork

Did you receive all attachments?
img

Debra, Expert

Well I wouldn't really know if I received all of the attachments but I've received quite a few but you still haven't really given me an answer to my questions. I want to know if you have your things and I want to know what the explanation is.

Customer
we have received all of our furniture etc...there is nothing that was not delivered
Customer
What explanation are you looking for.
img

Debra, Expert

Why are they saying that it cost way more than they said it would cost.

Customer
No one came out to see our home and my sons apt. Ontario Van Lines came in the middle of the move, and said the quote from Get Movers was wrong and the weight would be greater than the 6000 lbs we were quoted.
Customer
The weight was quoted as 6000 lbs, the actual weight, which we did not know until the delivered everything was 11920 for one truck and 13540 for the 2nd truck

Debra, Expert

In Ontario if you are given a written estimate they can't charge more than 10% above the estimate. So given that you already have your things you should refuse to pay anything more unless they agree to only charge you 10% more and you have a full written release from them. I would be shocked if they were to sue you because they have to know that what they are doing is unlawful.

Does that help?

Customer
It does but what if they either come after us-sue us or send us to collections
img

Debra, Expert

If they sue you it will be in small claims court and I will assist you through the site. They won't be able to succeed given the consumer protection laws in Ontario.

Customer
Would the quote that I sent to you from get movers be considered the written estimate
img

Debra, Expert

Yes!

Customer
What do I say to the owner of Ontario Van Lines when he calls me, or do you do letters up on our behalf to send to him?
Customer
I will pay extra for this service..
img

Debra, Expert

Don't you have the real estate lawyer do the letter. I am retired and the site would not allow it anyway.

Customer
No the real estate lawyer in Ontario only does real estate.
Customer
Is there a lawyer that you could recommend in Ontario that could support me with the letter and follow up?
img

Debra, Expert

But I'm sure that real estate lawyer will just do one letter. Anyone can do the letter. If not then you have to retain a litigation lawyer.

You can contact the Law Society and use their Lawyer Referral Service. You will be given the name of a lawyer and can consult with the lawyer and the first half hour will be free.
