I am trying to prepare my evidence for the second dispute resolution hearing I will apply for which is to request

Customer: Hello DebraI am trying to prepare my evidence for the second dispute resolution hearing I will apply for which is to request monetary compensation for each breach of quiet and enjoyment. The furnace is one of the big ones. As I was going over the new evidence supplied by the respondents, I noticed in one of their documents they omitted Ashton Service Group as one of the technicians that responded to a furnace service call, but it was because of this technician the furnace was shut off. The landlords insisted this furnace was safe and it made up by me. The landlords were responsible for this furnace being shut off on January 29 but a new one was not going to be installed until February 2 and they knew this at the time as well. I asked them in the rental unit why the furnace was turned off and they did not respond, so I sent them an email yesterday and took screen shots for you to view. They continued to evade my question, and then in the final email i stated my intention, that I had evidence why the furnace was turned off on January 29 and was hoping they would be kind enough to tell as well. I then went on to say that I will not be asking about the furnace anymore, rather I will bring it up at the hearing. I maintain that you are not allowed to shut off a furnace that's safe, and they maintained it was safe so why did they shut it off knowing that one will not be installed for another four days? I am trying to set them up for the next dispute resolution hearing.
Pics of the email and the proof I have why the furnace was shut off. This person also told me to ask the landlords why they shut off the furnace and the emails are how that turned outThen they sent me an email saying they had listed this house for sale.

Debra, Expert

Hello and Welcome to JustAnswer. My name is***** will be working on your question today and I am looking forward to our conversation.

Debra, Expert

Please note that I am working from my computer and not actually texting. If you don’t answer back for a while I may not be online when you do but I will never desert you and will check back often. As well, as I am working from home it is possible that I will be interrupted but I will always return back as soon as I can.

Finally, although the site offers a call option I personally do not take calls but just work online. Some find this confusing as it looks like the offer is coming from me but that is just how the site presents the offer and it really isn’t coming from me. Some of the other experts do take calls and so you are very welcome to request a call on this post and an expert may take it. They will have the benefit of reading our exchange which should work out very well for everyone involved!

I know your question is important to you and I will be giving it the time and attention it deserves.

I am sorry to hear of this difficult situation.

Your reasoning is very clear and sound.

Customer
What did you think of their email responses
Customer
they never answered my question
img

Debra, Expert

I know they didn't and that's excellent because it shows that you're right and that they're wrong. Your reasoning is really strong here.

Customer
Can you tell me if this audio clip with the field supervisor Kevin Wiersma will help me
Customer
He found out why Ashton Service group turned off the furnace, because of corrosion in the heater exhcange
Customer
when there is rust, there is metal being compromised, leading to perforation allowing CO2 emissions to enter the living space
img

Debra, Expert

Well I don't think the recording does show what you're saying because this he said that they did not find any CO2 emissions. He's really saying it looks like it's probably safe but the owner decided we better turn it off possibly just in case. That's what I got from the recording to be honest.

Customer
Thats true but I spoke with an HVAC technician and asked what corrosion in the heat exchanger meatn
Customer
meant
Customer
It means that when corrosion is present it will eventually lead to perforation allowing the CO2 emissions to enter the living space
Customer
no it was not dangerous at the moment, but the risk to keep it operating and have those probelsm was too great
Customer
I think the tech persuaded them to shut it down and replace it, because you can't reverse the rust damage, when this occurs tuypically a new furnace is needed
Customer
The tech also said there was no heat
Customer
I was wrong, there is no mention of no heat
Customer
I do know that the landlords only decided to get a new furnace because Ashton strongly recommended it, explaining what the corrosion meant
Customer
If they landlords kept it running and something bad happened, could be a lawsuit
Customer
After I told the landlords I had evidence why the furnace was shut off on January 29 and I would just bring it up at the hearing, they sent me another email saying they were listing this house for sale. What do you make of that
img

Debra, Expert

Well it could be that they think you're too difficult or it could be that they decided that they can't afford the house that is getting too old for them to afford or they could be just wanting to get rid of you.
