I see. So currently there is joint custody but the child lives with the father? I'm assuming you want your child to live with you?

I'm confused when you say the child lives with you but you have part time visitation. However, typically there is a presumption of joint custody unless you can show that the father is e.g. unfit somehow. What do you mean when you say the father wants control? Does that mean he wants sole custody or he is fighting your suggestions for visitation?

I'm sorry that you had to run to a shelter that must have been a very traumatic experience. Would you be interested in shared custody where the child lives with you sometimes and the father sometimes? I know you don't want the child to have overnights because of trust issues but if you don't have a viable reason to stop the father from having overnights ie. he has a drug problems or he's abusive to the child, you will be unsuccessful trying to prevent the father from having overnights.

I read the letter from the lawyer and it sounds reasonable unless your saying the father is psychologically abusive to the child. If that's the case you should advise the lawyer that is your position and file a motion. This will be done by your legal aid lawyer when you get one.

It shouldn't take more than a couple of weeks to get a lawyer and your ex will not be able to accomplish those things before you obtain counsel.
