Hello – My name is ***** ***** I’m happy to assist you today. I am a Canadian lawyer who is able to answer immigration law questions.

Can you tell me more about your question ?

Customer
Hi. I'm an international student in a College in Ontario. I have been studying business marketing which is 3 years long. I also completed my high school education here in Canada. So I have been here more than 6 years. I will gradute from my colleg soon and my plan is to apply for post gradutation work permit. I have a few questions about that.1- I have dropped courses in previous years and I fell into part time student status. 2 times. I never worked during those times. My sucess advisor told me that it may become a problem when I apply for post graduation work permit. She said they will want me to explain why I dropped courses and fell into part time student status 2 times. Do you think that would become a problem and if it would, is there a solution for that ?2- My second question is about an unofficial break. In 2019, I've missed a semester in fall. I was back in my country and getting denteal treatment which was 2 months long. I didn't know that there was such thing as unofficial break. I thought as long as I make the payment I'm counted as a student. I didn't knıw I would fell into this position. I can bring offical doctors note who took care of me if that would be enough. My success advisor told me I will have to explain why I didn't attend that semester. She said these things may be a problem for me in future. Can you please tell me if there's any solution for there 2 questions or what can I do ?Thank you.

Thank you for this additional information.

Can you tell me why you dropped those courses ? So then you were gone for that semester, did you ask for a leave of absence ?

Customer
I dropped them because my success advisor told me it is better than failing. I never knew this would become a problem for post graduation work permit. For the semester when I was not in Canada, I did not ask for leave of absence because I thought as long as I make the payment, I would be counted as an official student. I didn't know there was such thing as "unofficial break"

I see- So how many semesters were you a a part time student ? Was one of these semesters your final semester because you are allowed to be part time for that last semester ?

Customer
No, it wasn't. It was first and 2nd as I remember but not my final semester for sure

JJL11, Expert

So you were part time for both semesters of one school year ?

Customer
Hi
Customer
Or maybe 1st and 3rd semester, I don't really remember the semesters
Customer
Would there be a difference if it was 1st and 2nd or if it was 1st and 3rd?
Customer
I guess it was 1st and 2nd semesters...
Customer
To be honest, I'm very afraid that all these years I spent in this country will be for wasted for just becase a few courses I've dropped. I never knew that dropping a course would affect my post graduation work status...

I understand and unfortunately, the rules for getting a PGWP are quite strict.

Because you have had part time status for two semesters and did not study for one semester, you will have difficulty establishing that you were a full time student during your course of study. A letter of explanation may help but I would strongly suggest that you consult an experienced lawyer for advise before submitting your PGWP application to increase your chance of success.

Customer
I can easly prove that I had to stay in my country that semester in order to complete my dental treatmentş. I just need some advice from you for the part time student status
Customer
I didn't even know that I'd become a part time student when I drop courses. I've been told that failing would be much worse than dropping. If I knew, I would never drop those courses.

I understand - Your school can provide you with a letter to explain that even though you were advised to drop these courses rather than fail , even though you dropped some courses, you were still actively pursuing your course of study and made up these courses in the summer so that you were able to complete your course of study as if you had been a full course load during the regular school year.

Customer
I also attending summer semester
Customer
Please be honest with me, do you think I would be able to get work permit if I had good explanation for these reasons or am I just wasting my time here ? I have been in this country for so long and I don't want it to be wasted...
Customer
thank you for your all answers

That is good - in that case, I would have the school write a letter explaining my previous point and to say that you able to complete all of your courses within the 3 years.

You are very welcome.

To be honest, it is worth a try to apply because you have nothing to lose as you did complete your course of study within the 3 years so with a carefully worded letter from the school, you maybe able to get the PGWP.

Customer
I still have 2 semester ahead of me. But I'm planning to change my program from 3 years to 2 years. In that case I will graduate end of this summer. Do you think that would make a difference ?

This should not make a difference to you getting a PGWP but it will affect how long your PGWP will be eligible for because the length of the PGWP depends on the length of your course of study.

Customer
My success advisor have told me I'd get 3 years long work permit even if I sudy 3 year or 2 year long program
Customer
she said your only concern should be the semester you didn't attend which I have a good explanation for and the part time student status
img

JJL11, Expert

If your program is more than 2 years, then it will not make a difference to the length of your PGWP. If your program is less than 2 years, then it affect the length of your PGWP.

I agree with your advisor so you should having a good supporting letter from the school on these points is important.

Hope this answers your question.
