I'm not so sure that this will change anything because he's going to still take the position that he brought that home into the marriage even though your name was later added onto the title.

Ok I see it’s complicated. I though there was a difference between “jointly tenant” and “tenant in common”. Not only I became tenant in common, but I also took responsibility for the remaining of the first mortgage and we took on a new mortgage together.

There is a difference in terms of a joint tenancy and a tenant-in-common situation but it has nothing to do with what you are dealing with. It's has to do with what happens when you die.
