Customer: We have a signed 18 month Tenancy Agreement. Two weeks prior to the start of that tenancy there was a fire in the kitchen of the residence. We had no other option but to move in.
JA: What steps have you taken so far? Have you prepared or filed any paperwork?
Customer: It's been 8 months now and we still have no kitchen cupboards installed. Appliances were to be provided by the landlord but there was a delay in delivery so we purchased our own fridge and stove.
JA: Where is the residence located?
Customer: Our rental fee is $1725 per month. In the agreement the tenants were to pay for hydro and gas, however, there was a verbal agreement that the landlord would pay those utilities until the construction was finished.
JA: Anything else you want the Lawyer to know before I connect you?
Customer: The construction has not been completed and the Landlord has notified that the Tenants will be billed for Hydro and Gas retro January 2021.

Is the only thing missing the kitchen cabinets? What state are you in? Approximately how much does the water and gas cost monthly?

Flooring was just installed in the kitchen/dining/living room. The cabinets have been sitting there in boxes for a few months.

In Ontario that laws that protects tenants is the Residential Tenancies Act.

The Act provides that it's the Landlord's responsibility to keep the home in good repair.

You may not withhold rent but have other options available to you. Before you exercise these options you have to make your requests to the Landlord in writing.

After that one option is to call the government agency that enforces housing by-laws and regulations if you feel these are being breached.

You can call 311.

At the same time you can file a complaint with the Landlord Tenant Board.

Use T6

You will note that on this form you can ask for a rent abatement, or to pay some of the rent to the Board until the repairs are done. You can also ask to do the repairs and get paid back or have the landlord do them.

So the bot***** *****ne is that you should be getting a rent abatement and that would likely be above the credit for the utilities and of there is no doubt that the landlord cannot renege on that agreement.

I suggest you contact the Landlord Tenant Board to discuss this but you have to call first thing in the morning if you want to get through.
