Customer: Hello I was charged with fraud over 5000 in Alberta I had plead guilty and before my sentencing I have moved to Ontario so I did not attend my sentencing hearing so my lawyer said I have an unendored warrant not sure what that means .. I was also on probation at the time fir the same thing fraud over 5000 so Im not sure if because i didnt show up to my sentencing if that would give me another warrant .. What is the likely hood of someone arresting me here in Ontario for those warrant or warrants ? Also if I travel to Jamaica on a flight in and out if Toronto but dont touch down in Alberta will i be detained at the airport i know nothing is 100% but in past experience what is the likely hood

I am sorry to hear about your difficult situation. Whether you can be arrested in Ontario on an Alberta charge depends on the type of warrant you have. Unendorsed just means that if you are arrested, you can be brought before any judge so that does not control or make a difference in your situation. If it's a Canada wide warrant, then you can be arrested in Ontario and if it's not Canada wide, then they might just tell you that you have a warrant and let you deal with it. For really serious charges, they can 'gate' you basically hold you and check with Alberta to see if Alberta wants you back bad enough that they are willing to pay the costs etc. For a charge of Fraud, I doubt it, but it would be impossible for anyone to tell you for sure.

Same is the situation with the airports. Customs may or may not execute the warrant regardless of where they are depending not eh circumstances. But if I wanted to be on the safe side, I wouldn't come across customs as they are known to execute all warrants regardless of Province where they are from. One thing you an do is contact your local non-emergency police line and or court and give them your name and DOB and ask them if you have any warrants and see what they say whether the AB warrant is Canada wide or not Provincial only. That way at least you will have a little better idea about your situation.

Do customs check every person coming through ? Also will they check on the way out or when I arrive back ? Also so what would happen if customs executed the warrant they would pay to transport me back to Alberta or send me back to deal with it ?

Yes, customs runs everyone through the system. It's usually on the way back I would imagine when you're entering Canada as when you are leaving I doubt they care too much. IF customs executed the warrant, they will likely transport to AB, again will depend on how bad AB wants you as they might just say they don't want to incur the costs. But that part is impossible for anyone to know, if you know what I mean?

I just called the police station they will not tell me over the phone only in person ... So at the end of the day no matter if it is the police or customs who runs into me it is up to Alberta if they will pay to transport me back is what Im getting ... How likely is that they will transport me from Ontario all the way bk to Alberta for a fraud over 5000 charge and probably also breach ? ... I have only 2 things on my criminal record which is both fraud over 5000 charges ...

No one could tell you what the likelihood of something like that happening is. It is not something that is ever discussed or published or made known to anyone outside the circles of actual people that are involved in the system. Call your local court house criminal desk and ask them to do a warrant check for you and they will likely not ask you to come in person. That is how it is at least in Alberta, I am not sure if Ontario also follows the same procedure for these things.

I personally don't think that there are many chances that AB would want you at a cost like that for charges like Fraud as they are not super serious, but that being said it is just a guess at the end of the day.

Fraud is not super serious I was charged under an indictable offence i felt like it was the same as assaulting someone with a weapon i know it is serious but they were trying to jail ne for 3 years for this charge and I have 3 kids with no other family but me .. Who would end up in the system if i went to jail .. What are the usual terms in which the crown puts a canada wide warrant ? Im having a hard time finding out and have called Calgary police station and court house since thats where I was charged ..

Severity of the offence is typically determinative of when the crown puts a Canada-wide warrant out. Fraud in itself is not super serious, but if they wanted 3 years, it as likely from an employer or in a large amount, which then again is not super serious. What is your name and DOB, I will see if I can find out about the warrant.

From employer is considered a breach of trust so that's why the jail sentence. Particularly since it's the second time. But hang tight - let me see what I can find out.

Alright, so there's a warrant out of Strathmore and I am told it's Alberta wide only.

Does that mean it is 100% only provincial wide ? And 1 more question does the crown ever go back after some time and try to get a canada wide warrant if they are unable to arrest me with a provincial wide warrant ?

Yes the clerk indicated that it was a provincial warrant. In regards ***** ***** second part, no I don't think so. I can't quite comment on what the inner workings of the crown office is like, but I would imagine they won't bother with something like this on a regular basis.
