Are you the parent that pretty well takes care of the child day to day?

all day long. The other parent just appears for a game time session, or to accompany me to drop the minor to school after the morning routine is 100% complete (waking up the minor, bathing, dressing, breakfast, lunch preparation, instructing the minor to wash teeth, supervision that all gets done on time to go to school, then drop off and pick up the child to/from school). When the minor is back from school is sort of the same thing. The other parent only shows up for some the fun time after school is over or occasionally to read a book at bedtime.

Then all you would do is testify about all of this. It's clear that you do everything and that this father doesn't take care of the child at all really. It's not going to be an issue because he's not going to be able to lie about it. You will both testify under oath and if necessary you'd bring in witnesses if you had to.

Is the testification done through a document redacted by a lawyer or verbally in front of a judge? Regarding his testification, I believe he would be able to lie about it making up excuses that I do everything because I don't let him. It will be his word against mine. It's just the 3 of us at home, so no witness sees the day to day. My mom is visiting for 6 month, would she be a valid witness of what happens at home?
This is why I asked for any type of proof I can provide that could be considered legally acceptable.
Also he has been aggressive sometimes by shouting and hitting me. But I have no means of proof for this. Should I record this events with a hidden camera at home? Is that legal?Thanks for helping me. I am going through a difficult situation and I am getting informed on what is correct to do before I file any separation..

If he hits you call 911. He will be charged and placed under a no contact order and your case will be much stronger.

You will testify live, under oath and so would be. Your lawyer would cross examine him under oath and his lawyer would cross examine you.
