Customer: early sept. Someone I knew briefly in the building threw me against a wall causing me to severely injure my shoulder. I also had abrasions on my elbow & head. I called the police & they came, but determined there was no need for a report? I also was recording the incident on my phone but it stops as I fell to the floor. The police said that wasn’t enough evidence?
JA: What province are you in? It matters because laws vary by location.
Customer: ontario
JA: What steps have you taken so far?
Customer: i have phoned the police many times & finally got a Sgt who sent over one of the officers from that evening to take my statement & make a report. He also took a statement from the accused who said he was trying to get the phone out of my hand? I was 4’ away from the door?? Holding my own property & he admits he tried to take it?
JA: Anything else you want the Lawyer to know before I connect you?
Customer: Recently, a few nights ago. I was home from work & heard rather loud knocking on my door. I went to look out the peephole & they had their finger over the hole. Of course I’m not going to unlock my door. They knocked again, I looked, again there was a finger over the peephole. I called the police after not hearing anything from the police for a while, I called back and asked if anyone was coming? They told me that yes they were they and looking around outside?? That’s great! I’m on the 10th floor of an apt building. I asked if they were going to come up & speak to me? The operator said “if they need to, they have your phone #??

Hello and Welcome to JustAnswer. My name is***** will be working on your question today and I am looking forward to our conversation.

Customer
Will you be calling me?
img

Debra, Expert

Please note that the experts don’t text so there may be a bit of a delay. If you don’t answer back for a while I may not be online when you do but I will never desert you and will check back often. As well, as I am working from home it is possible that I will be interrupted but I will always return back as soon as I can.

I am sorry to hear of this difficult situation.

No. I won't be calling you. I don't take calls. I just work online.

Do you know who the person is who harmed you?

Customer
Hi Debra. My name is Geordie. I have some more information as well. I told the police there was a CLEAR fingerprint on my peephole & that they should come take a print. They didn’t so I used some tape and took a copy of the print myself
Customer
his name is*****
Customer
I have contacted the Head of Minto & he is well aware of everything. Apparently Ryan is known to numerous people in the building as violent etc. I however didn’t know this
Customer
How can I get a copy of my report, including his statements as well
Customer
Also, Ryan was briefly in the military. Would there not be fingerprints on file?

You can make up information request to get a copy of the report but his name will be redacted.

I'm quite sure his fingerprints will be on file.

I don't know why but the police are going to help you.

There is another route you can go if the police will not assist you.

You can attend at the Justice of the Peace's office in any criminal court.

You simply walk in, tell the JP's secretary what you want to do, and he/she will give you a form to fill out (basic information and your allegations).

Then after you hand it in, you'll speak to the JP and explain the basis for the allegations.

Then if the JP decides there is enough to lay the information, he/she will schedule a pre-enquete (relatively brief in camera hearing to determine whether or not to proceed).

Be prepared to bring any evidence or witnesses you might have for that.

I think that is your very best next step.

Does that help?
