Customer: i live on a private road that has a road committee. they decided that they would divide the road into four sections. section one is the common road part from government road to our "intersection". from intersection road goes three ways. they decided half our annual fee goes towards common section but half would go towards each other section. the other sections have quite a few living on it but my section only had two. there is a culvert on my section that is collapsing and they are saying its up to me to repair it even if i have to pay for it myself as their share of annual fee is for their section and its my responsibility to keep my side passable. what is the actual rules on this

How does this road committee have authority and how did they decide to divide these sections up in such an unfair way?

committee is mandated in the deed....its in cottage country....the committee was elected apparently by vote before i bought house......the president lives on one end of my road and i on the other....the majority of land owners are on her side of the intersection....they voted to divide the yearly fees like i said this way the surplus on thier side of road gives enough to snow plow that section.....we all pay to snnow plow up to the intersection...she says there is no money allocated for repairing any thing on my side and i think she believes its up to me to maintain my side......i dont mind for small repairs but this will cost thousands to fix....i can barely get over the culvert now and its erroding quickly

Well I don't think they can and if they can they have to do it fairly. This is not equitable. They can't make one person pay more than anyone else just because less people live in your section.

So I suggest that you nip this in the bud and you have a lawyer send a letter demanding that they need to change their arrangement so that everyone share in every cost equally or threaten to take them to court.
