Customer: I own a property in Hrm my neighbor in the back has a back yard which joins to my yard when I purchased the property in 1993 I had a location certuiicate which showed my property line which is around 9 feet at on end of building and 4 feet other end building 36 feet wide. So when u had licatiin certificate done I showed my neighbor and he agreed he did not have or anything to contrary. I never used back space for anything other the access to my building. The neighbor was a hoarder and occasionally had junk all around his yard which i reminded him this my property and to please keep debris of. 25 years later he died the property was sold and the new owner was also notified by me that my property extended past my building into the yard. And was notified by me not to go on my property which he agreed to. Then behind my back he installed two retaining walls used my building for the third and filled it all in and built a parking lot in my land.

Please note that the experts don’t text so there may be a bit of a delay. If you don’t answer back for a while I may not be online when you do but I will never desert you and will check back often. As well, as I am working from home it is possible that I will be interrupted but I will always return back as soon as I can.

I am sorry to hear of this difficult situation.

I saw what the other lawyer said and it will be a bit risky in my view. At least, have that lawyer, or another lawyer send them a letter demanding that they remove the parking lot and the retaining walls by the deadline that you set and threaten a lawsuit. If you start removing these things yourself they may call the police who may try and stop you.

Does that help?

I am sorry for the terrible delay. Unfortunately a customer service representative decided that this was about the law in the US and moved your question to the US law list even though this is about Halifax Nova Scotia.

Because it was the weekend I couldn't get it back until now.

I didn't say that you should sue and take a long time for that to happen. I said to pay a lawyer to send a letter threatening a lawsuit. I suggest you do that before you start removing the items yourself.
