I have asked my lawyer and her asst for over a month to view it scan ex’s binder w disclosures stuff. He was compelled oct6 then my lawyer didn’t go to court nov 5 gave more time then agin November 20, detailed email giving again more time and what undertakings are incomplete. She never did ask for his check statements which would show what he spent on affair, that we were never separated and transfers. Now I am told that’s in round two of questions. Also back in sept she said she would be going to special chambers for retro spousal, now I am told that’s at trial. Yesterday I asked to come and see the binder or scan it myself because I’ve asked several times for some fit to be scanned and sent to me mainly the life insurance policies in the RSP’s and she said I think you’ve had answers to those questions. It’s only once I send an email or make a few points of stuff that we’ve been waiting for and then send her money that she’ll get on something and actually it’s been awful. It’s too late in the game for me to get another lawyer. I have three main concerns:
1. The $345,6k leveraged LOC investment is missing 2008,2009 transactions (May 2020 ex provides bank blog from 2007/08) this was to collapsed and in 2010 a new LOC (joint) opened yet my disclosures is showing it started w a large balance owing if $146,k. Where did that go?
2. Schedule A January 2020 shows debt against life insurance policies(claims I owe half) when? Where did the borrowed funds go and life fund value to borrow $92k is an asset
3. His Rrsp disclosures is missing pages it’s less than thorough
All the LOC transactions we loose 2013 in January 2021 as banks cannot. Go back that far they said. There’s large transfers in 2013. I had no access. No knowledge.
Can I set of a few of these vip to me and tell her what I want. She doesn’t listen at all.

I think you should tell her that many documents are missing. They are key to piecing the financial picture together as so far it looks like he has dissipated the family assets.

Then list each set of documents that are missing and ask her to get demand them at once. If there has been an order to produce them and he is not ask her about seeking a finding of contempt.

Does that make sense?

She missed many things in discovery such as checking statements which prove both we were not separated and dollars spent on his affair. Do we have to do a second round of questioning as she suggested. I am asked to go to discovery now January 25 by zoom. Also, he has TFSA within the life policies for each child yet zero disclosures and she never asked for or about TFSA. It’s gotten so hard to prove anything when we never shared anything and he controls all the accounts

The trail on that line of credit is really upsetting because as of January the bank loses all of 2013 which has a number of large transfers it definitely raises questions that all I knew about was a down payment for a duplex of 58,000 and disclosure shows by the time I even signed the documents back in 2010 the line of credit was at $146k
