Customer: I live in the north and have well and septic. My house is a duplex. I lived in the house prior to having tenants with 3 more children/teenagers and there was no problems. Since the tenants have moved in I have pumped the septic tank 5 thousand liters twice in 2 months. The septic can not handle this level of waist water. Showers are 25 minutes 3 times a day and a load of laundry everyday there are only 2 adults living there. My investigations have lead me to believe I am required to give 120 days for renovations. I can not give that notice and need them out now as I can not have a pump truck into the location with the snow we have now and through the winter. What is the best way to get them out fast?
JA: Because laws vary from place to place, can you tell me what state the property is in?
Customer: Ontario canada
JA: What are the terms of the lease? Any issues related to maintenance or upkeep?
Customer: there is no lease so no terms for upkeep
JA: Anything else you want the Lawyer to know before I connect you?
Customer: I have been cross examined several time for several weeks and the prosecutor was unable to question me off the story I have told. You tell me what to say and it is said and will survive cross examinatiin

Please note that the experts don’t text so there may be a bit of a delay. If you don’t answer back for a while I may not be online when you do but I will never desert you and will check back often. As well, as I am working from home it is possible that I will be interrupted but I will always return back as soon as I can.

I am sorry to hear of this difficult situation.

Are they on a fixed term lease?

How do you know what they're doing inside the house? Who is living in the other half of the duplex?

Customer
We live downstairs
We could not get into a lawyers office prior to the tenants moving in as lawyers were not taking clients do to covid so the tenants moved in with no lease.

This would be grounds for eviction because they are denying you the right to peaceful enjoyment of your home or will be, because they will ultimately end up causing damages to the property and because they are abusing their privileges as a tenant.

You can bring an application to the landlord tenant board. The problem is it with Covid things take a very long time and you may not get into the board for months so you should tell them that you need an emergency hearing over the telephone because you and your property are going to suffer damages as a result of the tenants of use of the plumbing facilities.

Tell them that when the snow starts you're not going to have any plumbing for either unit.

Does that help?
