Customer: My brother in law had cysts around his right kidney, and when he first came to Canada in January, he was diagnosed to have a growing cyst in the mid of last February. But unfortunately the doctor didn't refer him to a CT scan as an emergency case, so his CT scan was scheduled for July. They didn't call for the ST scan, so he called his doctor, and let him know. Eventually, the ST scan was taken in August. After that the specialist said that there is no way to keep the the kidney and they had to remove it completely. They did the surgery and now, my brother in law has only one kidney. However when he came to Canada they could keep the kidney and remove only the cysts. But the delay that was because of the doctor's malpractice, lead to losing a kidney. We have talked to many other doctors before that and they all said there was no need to remove the kidney at that time(February). We want to sue the doctor that his malpractice caused that tragedy to my brother in law. Do you think you can help by following this case? Thanks

What you should know is that to succeed in a malpractice claim your brother-in-law have to prove the doctor owed owed him a duty of care and that either there was negligence or that the care provided was below standards of practice and then he has to prove that he suffered damages. The first and third factors are obvious.

But to determine whether there was negligence or not your brother-in-law would need to see a medical malpractice lawyer who would need to request the records and then have an expert review them.

Your brother-in-law cannot sue successfully if there was no negligence. Sometimes things go wrong because of the nature of what is happening as nothing is perfect so proving negligence is really the main issue here.

What you can do to find a lawyer is one of the following things.

You can contact the BC Branch of the Canadian Bar Association and use their Lawyer Referral Service. You will be given the name of a lawyer and can consult with the lawyer and the first half hour will be $25.
