I have a contract with a breader the states the following :"Purchaser agrees to have the puppy spayed/neutered by 12 months of age. Proof of spay/neuter must be writing by a licensed veterinarian. Registration will be transferred to the purchaser upon veterinary receipt of proof of neutering. It is hereby agreed that failure to comply with this condition will entitle the breeder to take possession of the puppy. If puppy is not spayed/neutered by 12 month of age, the purchaser will return the puppy, without a refund. If the purchaser is found to have bred the Poodle, the subject of this contract, the purchaser consent to give up possession of the Poodle to the breeder willingly without compensation."
Is it a breach of contract, if I have the procedure done to my pet before 12 months of age? The contract state "by 12 months" not "at 12 months".My question is :
My veterinarian suggest the procedure should be done at 6 months of age. Will this be considered a breach of contract? It does state "by 12 months" not "at 12 months", but I think this is what the breeder might want me to do..Thank you

You would not be getting in trouble with the breeder because the breeder is saying it has to be done by 12 months which is really before 12 months so six months would be perfect because the veterinarian recommend six months and it will meet your contract completely.

The contract says by 12 months and at 12 months is not reasonable because what does that mean - on the exact date? And should you should act contrary to what the vet says?
It's not the purpose of the contract anyway. She just wants to make sure you're not going to breed the dog.
