Customer: I purchased a travel trailer from an individual in Ontario ( I'm in Quebec). That vehicule has false documentation. Can I return it to the vendor and ask for a complete refund?
JA: What state is this in? And just to clarify, when was the purchase made?
Customer: The purchase as made Sept. 8 2020. It's in Good condition, BUT the VIN number on the sticker, is that of a vehicule which was declared IRRECUPERABLE au Quebec
JA: Have you contacted the seller or manufacturer?
Customer: I contacted the seller, who said he will try and sell it in Ontario, and refund any money when and if he does
JA: Anything else you want the Lawyer to know before I connect you?
Customer: what will it cost me for the lawyer?

I am sorry to hear of this difficult situation.

Have you asked the seller about this false documentation? I know you said he said he will try to sell it in Ontario but has he explained why there is a fraudulent document on the car.

Customer
Seller said he had no idea

It sounds like it may be true that the seller had no idea. But, now the seller is trying to sell it again and are they going to tell the potential new buyer the truth?

I suggest that you tell the seller that this is not acceptable and that you will be returning the travel trailer immediately and if they don't give you a full refund you will commence legal proceedings. You can sue them in small claims court for up to $35,000 and self represent. If the cost was greater than you will need to retain your own lawyer.

Does that help?

Customer
Do I file small claims court in Ontario? Or Quebec
Customer
Do you suggest any particular format for the email I intend to send the seller informing him of my intentions?Do I file small claims in Ontario or Quebec?

Debra, Expert

I suggest that you just send an email setting out the facts and then making it clear if you don't get a full refund you're going to sue them.

You would have to soon Ontario unfortunately.
