Customer: when a couple have been married for 13 years and the wife has 3 children from another man during those years and still living with the man she married. During all those the husband raises the children as his own does he have any legal rights with them?
JA: What steps have they taken? Have they filed any papers in family court?
Customer: no they haven't, When the older son was born and the papers that are usually signed by both parents at the hospital the legal husband had signed them. I think those are some kind of birth papers.
JA: Family law varies by state. What state are they in?
Customer: Saskatchewan Canada
JA: Anything else you want the Lawyer to know before I connect you?
Customer: Yes. What does he do with the oldest boy who does not want to leave him to go to live with the biological father who the mother left with?

Hello! My name is Debra (formerly known as Legal Ease). Thank you for your question. I'm reviewing it now, and will post back again shortly.

Debra, Expert

I'm sorry to hear that it sounds like you are in a difficult situation. I am not quite following the facts.

Are you saying that the oldest boy wants to live with the stepfather rather than the biological father?

Debra, Expert

Without the information I requested, I can only give a general answer, but I hope this is helpful.

A step father can apply for custody or access. The court will make a decision based on what the children want the court finds to be in the best interest of the children and not based on biological connections.

Does that help?

Please feel free to post back with any follow-up questions you may have. If you don't have any then I hope I have earned a 5 star rating but if you don't feel that I have please don't hesitate to reply back and let me know what more I can do to assist you. Finally, please know that even after you rate me I will be here for you and you can ask follow-up questions if you think of them later on at no further charge of course.
