Customer: We are ordinary citizens up against a big bank that did not follow the banking act for a personal loan and the legal system is not holding them accountable to do so.
I am just reaching out to see how one can hold banks accountable.
It is very hard to believe that an ordinary citizen can hold a bank accountable especially when they are unresponsive and proceed in believing that we are defaulting on a loan of a company
that went bankrupt 5 years ago. And for 10 years we had no communication from the bank about this loan and believed the company was looking after the loan.
Thanks so much for any thoughts or guidance you can provide.
JA: What province are you in? It matters because laws vary by location.
Customer: we Alberta
JA: What steps have you taken so far?
Customer: We have hired a lawyer and had summery judgement by a master judge ruling in banks favour a year and half ago. Our solicitor cut their fees and convinced us to appeal as the Master judge dismissed the banking act totally... We would like to negotiate a settlement but banks unresponsive and keeps added more costs to settlement.
JA: Anything else you want the Lawyer to know before I connect you?
Customer: We were thinking of reaching out to obusdman .:The bank has worn us down even though they didn’t follow contract laws or banking act. So just reaching out to see if their other ways banks can be investigated and accountable . It may not help us but maybe help other citizens hold banks accountable. They are above the law and master judge supported them . I feel the court of queen bench judge would also be crap shoot. We have a offer on property to sell and they put lien on it so I feel this is all coming to head. They won’t Remove lien unless we put all money in banks trust account. There is no date set for the appeal either . They keep adding more and more fees and gouging. We would like to negotiate but our lawyerS feel they won’t because they don’t think they will lose appeal and know we have money in property to pay them. Thanks

You can try going the ombudsman route. It is fast and free unless you pay your lawyer to do so.

You first have to complain to customer care. Then we know that is useless. From there you apply to the bank's ombudsman. That too will not work I am sure.

But then you complain to the governmental ombudsman who is not biased and that could work. Unfortunately you cannot skip any of these steps.

You can go into any branch of the bank and you will see a brochure on how to complain. In that brochure all the contact information you will need for the full process is set out.

Does that help?

Please feel free to post back with any follow-up questions you may have. If you don't have any then I hope I have earned a 5 star rating but if you don't feel that I have please don't hesitate to reply back and let me know what more I can do to assist you. Finally, please know that even after you rate me I will be here for you and you can ask follow-up questions if you think of them later on at no further charge of course.
