Customer: My question is the following: So I came to Canada on 16th February 2020 and Got married to my boyfriend in April 2020. I’m coming from a visa exempt country and so my visitor status expired on 16 August (6 months from the day I entered Canada). We submitted a Spousal Sponsorship application along with an Open Work Permit application in July and still haven’t heard from IRCC. My question is whether I need to apply for restoration of status or am I able to remain out of status while waiting to hear from IRCC? Will my out of status affect my OWP application?

You can remain in Canada without legal status once the spousal sponsorship has been started. You can get an open work permit.
