Expert's Assistant chat
Customer: I'm a townhouse condo owner. I have paid for a second parking spot in our parking lot for my mother who lives with us. She has a trailer that she stays at in the Summer and comes home periodically but the Condo board is saying that they want the spot back because she's not parking in it, even though it is paid for til the end of October.
JA: What steps have you taken so far? Have you prepared or filed any paperwork?
Customer: I informed the condo corporation by email that my mom is returning in September since her trailer is seasonal.
JA: Where is the townhouse located?
Customer: London Ontario
JA: Anything else you want the Lawyer to know before I connect you?
Customer: We have also used the parking spot when renovators for our home have needed a closer spot to our townhouse to work during the Summer. It has been used. Just not every day. When my mom is home, she uses our parking spot that is closer to our unit because I have a handicap permit and she is home with me all day. This way I don't have to walk across the other side of the parking lot to her car. My husband uses her parking spot instead because he drives it to work. If she is away of course we use our designated parking spot closer to our townhouse, but otherwise, my mom parks there for my handicap, unless we are all using our car together to go somewhere. I can type out what the letter says, word for word if you wish to see that as well.

Debra, Expert

I am sorry to hear of this difficult situation.

The condo board is incorrect and they are required by law to adhere to the terms of the contract. The contract is that your mother has a parking spot until the end of October and for this reason, especially since they are are being paid for it they cannot take it back.

Does that help?

Please feel free to post back with any follow-up questions you may have. If you don't have any then I hope I have earned a 5 star rating but if you don't feel that I have please don't hesitate to reply back and let me know what more I can do to assist you. Finally, please know that even after you rate me I will be here for you and you can ask follow-up questions if you think of them later on at no further charge of course.
