Customer: I came on a visit from usa in 2018 to canada, within 3 months of my stay I married my husband and applied for a permanent resident card, work permit too. I just recieved a refusal of my sponsorship as my husband was unable to meet sponsorship requirements due to being on temp. Medical assistance during the submission of the application . I was not advised AT ANYTIME to obtain a T.R.V. I was also told that while my application was pending process that I remained in implied status. Now that I have recieved the denial letter from immigration they are telling me I have NEVER been in status. I have consulted with a lawyer over this and there are a lot of open ended questions about all this.
JA: What steps have you taken? Have you filed any paperwork with the U.S. government?
Customer: Why would I
JA: Have you talked to a lawyer about this?
Customer: Yes , he said to check my status
JA: Anything else you want the Lawyer to know before I connect you?
Customer: Yes how do I collect any of the information needed when most of the offices are currently closed during this pandemic

Debra, Expert

Hello! My name is Debra (formerly known as Legal Ease). Thank you for your question. I'm reviewing it now, and will post back again shortly.

Debra, Expert

I am sorry to hear of this difficult situation.

Are you American?

What do you mean by medical assistance?

img

Debra, Expert

Without the information I requested, I can only give a general answer, but I hope this is helpful.

Usually it is only social assistance and not disability benefits that preclude a spouse from sponsoring so this doesn't make sense.

As well, if you are American or have a green card you don't need a visa so none of this is adding up.

I suggest you retain an immigration lawyer to take over this file for you as something is going wrong here.

Please feel free to post back with any follow-up questions you may have. If you don't have any then I hope I have earned a 5 star rating but if you don't feel that I have please don't hesitate to reply back and let me know what more I can do to assist you. Finally, please know that even after you rate me I will be here for you and you can ask follow-up questions if you think of them later on at no further charge of course.
