Expert's Assistant chat
Customer: Here's my situation: 1 month ago I phoned my landlord because I had bedbugs and requested he call an exterminator. Yesterday I received a letter from a bailiff which claimed this was a false statement because the exterminator didn't find any live bugs, but there were and I continued to find them days after, and so he wants me to pay for the treatment. After that, he goes full vindictive mode and claims my bike has been damaging the walls of the stairway that shares his and my apartment and I have to touch-up the walls. The problem with this is I haven't rode my bike for 2 years for this same reason. I didn't want to damage the walls. This is followed by the accusation I was not living up to the agreement of cleaning the shared space (stairway). Problem with this is I had never heard of this agreement, there is no mention of it in the leases which I've found going back to 2014. This is followed by an accusation of hoarding, which I'm not, and I have to clean up my apartment, replace my bed. Failure to do any of this, the letter states from the lawyer, could result in the termination of the lease. So my question is: I know all this is the result of my asking for an exterminator. The reason I asked for one is because I read on the Regis de rent site it is the obligation of the resident to inform the landlord about an infestation. I really didn't expect this to wind up as an eviction otherwise I wouldn't have asked. So, what do I do? The easiest thing is to roll over and do everything the letter states just to avoid getting evicted, but I don't like it because it feels like he's trying to push me around, when all I was trying to do is the right thing. Sorry for the wall of text.
JA: Because laws vary from place to place, can you tell me what state the property is in?
Customer: Quebec
JA: What are the terms of the lease? Any issues related to maintenance or upkeep?
Customer: No. I found the leases back to 2014 and there is no mention of an agreement of upkeep. It feels fabricated.

JA: Anything else you want the Lawyer to know before I connect you?
Customer: I'm basically wanting to know what the best course of action would be. I came home from work tonight planning on writing back to the lawyer refuting everything I wrote here now, but then thought what if that's the worst thing to do.

Debra, Expert

I am sorry to hear this.

What you do is clean up your apartment and at the same time take the landlord to the Regie for an order that the landlord take all necessary steps to rid the home of these pests and for an order that the landlord cease and desist from harassing you.

Does that help?

Please feel free to post back with any follow-up questions you may have. If you don't have any then I hope I have earned a 5 star rating but if you don't feel that I have please don't hesitate to reply back and let me know what more I can do to assist you. Finally, please know that even after you rate me I will be here for you and you can ask follow-up questions if you think of them later on at no further charge of course.
