Hello - My name is ***** ***** I'm happy to assist you today. I am a Canadian lawyer who can answer immigration law questions.

Can you give me more details about your situation ? Why did you not renew your work permit before it expired ?

Customer

I see - When did you submit your PR application ? Have you gotten any sort of confirmation of this application yet ? Were you found to be a convention refugee and that is why you are applying for PR ?

Customer
They accepted my refugee claim in 2018 ..i submit my PR in june 2019...and they keep sending me stuff to provide ..like informations about my family in Syria...and 2 week ago they asked me to provide 3 different police clearance from 3 countries i have visited before in my way to canada..and i am still working to provide that until now.

Since you have been recognized as a convention refugee, this is your immigration status in Canada until you get your PR. You legal right to remain in Canada is not dependent on having a work permit. You were given an open work permit incidentally because you made a refugee claim. Therefore, the expiry of your work permit does not affect your status in Canada and should not affect your ability to get a new one. Your situation is different than those persons who came to Canada to work and cannot be out of status or they may not be eligible for a new one. However, I would caution you that you should not be working right now because your work permit expired.

Does that make sense ?

Usually, if your work permit expired less than 90 days ago, you can apply for restoration of your status but since 90 days has past, you need to submit an application for a new work permit and you can do this online or by paper application.

Here is the link to the Canada Immigration webpage about how to apply

https://www.canada.ca/en/immigration-refugees-citizenship/services/application/application-forms-guides/guide-5553-applying-change-conditions-extend-your-stay-canada-worker.html

With respect to your CERB claim, it might be more complicated because you need to have been able to legally work in Canada to get it and you had no valid work permit for the time period you received CERB. I would suggest that you tell CERB that even though your work permit had expired, you are in the process of getting your PR and provide any confirmation you can of your pending application.

Hope this answers your question.
