Expert's Assistant chat
Customer: My dad died in 2008 and I have a copy of his will naming me as executor. My mom is dying and I lost the copy of her will. The will is from 1987 and the barristers and solicitors are out of business. I am power of attorney for her and the estate is well under $25,0000. What do I have to do in order to administer her estate?
JA: Since estate law varies from place to place, can you tell me what state this is in?
Customer: BC
JA: What documents or supporting evidence do you have?
Customer: My power of attorney and my a copy of my dad's will.
JA: Anything else you want the Lawyer to know before I connect you?
Customer: Will chatting with a lawyer cost me anything?

Does your mom have a living spouse since your dad died?

Are you the only child?

Did you do a Wills search?

Customer
No spouse, only child and no I have not done a search yet.

You should first do a Wills registry search and can do that if your mom appointed you under a POA or else you will need to wait until she dies:

https://www2.gov.bc.ca/gov/content/life-events/death/wills-registry

As well you can contact the law society and as where the files of this firm have gone. When a firm dissolves the files are handed to the law society who stores the if they don't go to another firm.

Here are the numbers to call:

Telephone:(###) ###-#### Toll free: 1(###) ###-####

If you cannot find the Will then you can apply to administer the estate but you will have a problem as you know there is a Will.

Here is a link to the information you will need:

Does that help?
