Customer: I'm not sure if you can help me or not. Its about my son's partner. She is mentally abusing him and getting him so far in debt. She is angry with me because I responded to someone on Facebook over a post she did. She posts crazy stuff and is always changing accounts. She told me she was opening one for the kids on FB as they had ones just for kids. It turns out it is all a lie and its her account and she just changed the name to the kids. The girls are 5 and 1 1/2 which is way to young to be on FB in the first place. my issue is that as soon as something is pointed out to her she takes the girls away from me. It is very hurtful and I hate how she runs my son down all the time. He works so hard and I doubt he even knows half of the things that are going on. If he is being mentally abused can he take the girls out of the home with him? There are 6 neighbors that have asked his sister what is going on and that they can hear her yelling profanities at him and the kids.

Has your son voiced any concerns?

How long have they been living together, are they married? And are the kids both of theirs or from another relationship?

My son has voiced concerns to his brother. He is afraid to say or do anything as she threatens to take his children away from him. They have been in a relationship for 6 years. In that time she has managed to alienate him from his entire family. She uses the children as a pawn and if you don’t go along eith her she takes them away by deleting you from messaging or on Facebook.

Unfortunately, if your son is in a common law relationship with this person, then he is able to make his own decisions, even if those decisions are unwise. If you are able to talk to him to try and convince him that his decisions are unwise, you can certainly do so; however, if he is a mentally capable person then even if you feel she is taking advantage of him, there is not legal action you can take against her as it is his choice.

If she is the mother of those children, then absent a court order or custody/parenting agreement, he cannot take the girls and leave with them.

That is the reason he stays, he doesn't want to lose his girls.

He can leave, just not with the children without her consent. If he gets a court order or agreement on such, then he can leave with the children.
