I am sorry to hear of this difficult situation.
If the repair shop did the damage why are they not paying for the repairs?

Have you told your insurance company that you were not putting this to the insurance because they are liable.
Is your insurance company going to sue them?

I don't understand. Are you saying that the insurance company believes that you were driving and caused an accident?
But the repair company actually caused the damage and is lying?

Then you may have to sue the repair company as they are committing fraud. You may also have to sue the insurance company. The only explanation the insurance company would have would be to say that while you may not have been driving someone was driving your car and caused the accident. So I suggest as a best next step that you nip all of this in the bud before it gets totally out of hand and you have a lawyer threaten a lawsuit because you are not being listened to. You have done as much as you can to prove that you are not driving and still nothing is working.
