Customer: I have cattle on my farm that ran away from a fellow 5 miles away , they belong to a man in Manitoba that are fattening them here , they jumped the fence and are with my herd , to get them out we need to build make shift corralling to split them up , there are costs for labour and material , Am afraid when the cattle are on the truck and down the road good luck for compensation , can I ask for a deposit to be adjusted , can we retain the cattle until a deposit is forwarded ?

Customer: We are building the corral that will be finished tomorrow , would like the cattle gone asap as they are eating my grass for my cows , the guy wants to load them and leave a cheque , if its not certified or money transfer , when there gone I am out of costs !
JA: Anything else you want the Lawyer to know before I connect you?
Customer: do I have the right to keep the cattle until they pay ? , and if not , can we sell them to recover my costs ? like a mechanics lean ?

HI, thank you for contacting Just Answer. Counsel Creed here. It sounds like you are in a "Catch 22" situation. Unfortunately, you CANNOT keep someone else's property (cattle) against their will - it is called a conversion or misappropriation and is a criminal offence. So, you have to release the cows. I agree 100% with you that you should ask for a money order, or a certified cheque, or cash - before the owner gets his cattle. The problem is that a regular cheque is also a legal way to pay in this country - so you have to accept it and hope that it will not bounce. Make sure to take every possible piece of information about this guy, including taking pictures of him, his truck (plates), driver's license, etc.

N o, The guy came this morning and the owner agreed to send a money order after I showed him the impound act of ontario! , It turns out the true owner is in Elmira Ont, the guy up here is just a front guy! They try to bully there way out, Your advise is right on with the Pound Act, with a little luck it should be good, Thanks very much!!
