Customer: I’m disputing a final amount with my car financing company. I’m not sure what type of lawyer I should be looking for or even if I have a leg to stand on. The amount is different from my contract and everything they sent me doesn’t add up either.

Customer: Ontario and no one is currently helping me
JA: Have you contacted the seller or manufacturer?
Customer: so I contacted the company I got the car from and they said that they can’t help me because this financing company pulled out of Ontario and took all files with them. When contacting this company they give me different number of what I owe
JA: Anything else you want the Lawyer to know before I connect you?
Customer: i have all papers they sent me with amounts differing from one an other. I did have missed payments and made double payments for what I missed and have emails with a women from the company stating that I have caught up and may resume normal payments. I’m not disputing the NSF fees. That’s my mistake. They claim I signed a contract to pay until 2021 which I did not. They also did not include a 1212$ payment my mother in law made as well

How much of anything do you believe you owe the creditor now?

If anything I believe I owe just my nsf charge which is around 650.

My contract states the total cost of lease (lease to buy contract) is 19520.40. I have already admitted fault for NSFs the was put on the account. I worked with a women (who no longer works with the company) to make double payments until all payments had been caught up. I had done this until she said I was able to resume normal payments. My contract ended 05/22/2020 and I'm now being told that I owe a total of 4823.29 and that because of my past with Non payments. I was also told I was paying until 2021. I did not sign a contract stating I would continue to pay until 2021 nor would I have agreed to that if I was making double payments.

Have they provided you with a copy of that contract it says you agree to be bound until 2021?

No they have not.

I did request my contract back in 2018 after my faults with the non payments. That contract also had a date of 05/22/2020

They are at best disorganized organized and perhaps dishonest. It's hard to know because it doesn't make any sense.

I suggest that you send them a letter by registered mail. In the letter include a copy of that contract and make a list of all payments you paid them over the years and show them what the final total is. Be sure to include the NSF charges and make it clear that you agree that you owe that and nothing more.

I suggest that you tell them that if they provide a signed release indicating that after you pay the $650 the contact is at an end and you owe nothing more you are happy to pay that amount of money.

Tell them otherwise you are happy to have them take you to court but you are putting them on notice now that if they harm your credit rating in anyway you will sue them for damages.

Sent them a copy of the contract. I've run numbers and it looks as those they have taxed me twice and charged me interest twice. I was under the impression that the total cost of lease was the amount that was to be paid in total correct. That's with interest and taxes or am I mistaken?

You are correct except that you may owe additional interest for the late payments.
