Customer: I am working as a Front Desk Guest Representative, and due to the virus , my shifts have changed. I was able to handle working 10:00 a.m. through 10:00 p.m. with the underrstand I would be required to sleep @ the Hotel, however would only be paid for 4 hours. I was ok with that, however I sent a text to my Manager to check what hours I was working for today (Saturday) & Sunday and was informed it would be 7:00 a.m. through 11:00 pm; not to sleep @ the Hotel as we now have our Night Auditor back who works 11:00 p.m. through 7:00 a.m. My Manager had all week to let me know about this change in my hours, and the only way I found out, was because I sent him a Text @ 9:30 p.m. Friday. If I hadn't sent that text, I wouldn't have shown up 'til 10:00 a.m. I am required to do this awful shift again tomorrow (Sunday) after one night on my own. So, that means I am working 16hrs Saturday and 16hrs on Sunday, which basically is 2 back to back shifts in the 2 day period. I probably won't get overtime because they just don't give it. Am I entitled overtime? I've been here since 2007, and I have never complained tp an outside source before, but I am finally fed up (as is my daughter), as he already deducted hours from 40 to 64.due to the Virus, but the girl working the 3:00 p.m. through 11:00 p.m. already has her 40 hours back. I'm working this ridiculous shift because he looked for anyone, and doesn't want to do it himself. I am going to be 64 this year, and I feel like he's trying to get rid of me, especially because he knows how much I need to be working and receiving a 40 hr paycheque. I feel trapped, and very, very sad; I have been through 5 managers and 3 owners, and by far this is the absolutely WORST! Thank you for taking the time to peruse this lengthy question. JA: What reason did they give you for the schedule change? Was this retaliation?
Customer: I really don't know; this just came out of the blue with absolutely no contact except the text he sent me telling me about the hours. There wasn't even an apology, or that this would be a one time thing, or even asking me how I would feel about it! I have not spoken to him today, nor have I sent any texts.
JA: Where are you located? Workplace scheduling laws vary by state.
Customer: I live & work in Sherwood Park, Alberta Canada
JA: Anything else you want the Lawyer to know before I connect you?
Customer: Well, should I call him to say I need to know what he is going to do about my hours tomorrow for sure, as who knows! He could change them in a flash

I am sorry to hear this.

Are you asking about overtime or about the issue of your shifts being changed?

I feel badly that I never heard back from you. At least let me explain how to find a lawyer in Alberta.

What you can do to find a lawyer is one of the following things.

You can contact the Law Society and use their Lawyer Referral Service. You will be given the name of a lawyer and can consult with the lawyer and the first half hour will be free.

The number is:

1-***-***-**** or
***-***-**** in Calgary

Or you can check on a site called lexpert. This is a legal directory of leading lawyers and law firms throughout Canada and is well-respected by the legal community.

Here's the link to their website:

http://www.lexpert.ca/directory/find-lawyers-or-law-firms/

Does that help as a starting point?

Please feel free to post back with any follow-up questions you may have. If you don't have any then I hope I have earned a 5 star rating but if you don't feel that I have please don't hesitate to reply back and let me know what more I can do to assist you. Finally, please know that even after you rate me I will be here for you and you can ask follow-up questions if you think of them later on at no further charge of course.
