Hi,

I'm a Quebec lawyer.

If the tenant has been paying rent, he as a lease by tolerance with renewable one month terms and legally he has the same right as a tenant who signed a formal one year lease for example.

The landlord has the power to demand that the lease be terminated because of the bad behaviour of the tenant that causes prejudice to other tenants. In fact, the landlord has the duty to proceed if alerted of such problems.

Thank you for your reply. My tentant has no lease. ( unfortunately) for bad behaviour how can I get him out? He is abusifs. I'm afraid it will escalate. Would like to avoid problems.As I understood I can renew written contact for one month for him to find a new place?
Then I can call the cops if he didn't move out on the date?

You unfortunately cannot kick out or resiliate the lease on your own. The tenant has the right to stay there forever. You can ask the Court (Régie du logement) to terminate his lease. If you provide sufficient proof of the continuous and grave harassment of this tenant, the Court will terminate the lease.

The cops do not help for eviction, but the bailiff will and only the cops if things turn violent. Calling the cops will not terminate his lease, although it could maybe convince him to leave if he is committing criminal acts.
