Expert's Assistant chat
Customer: If I own property with another person and I told him he could buy my half and then change my mind, can a judge force me to sell it to him
JA: What state are you in? It matters because laws vary by location.
Customer: I’m in British Columbia, Canada
JA: What steps have you taken so far?
Customer: I’ve spoken to a lawyer but have received not good legal advice. I don’t want to sell but the other owner is bullying me to sell to him

Hello! My name is Debra (formerly known as Legal Ease). Thank you for your question. I'm reviewing it now, and will post back again shortly.

Debra, Expert

I am sorry to hear of this difficult situation.

Was the agreement in writing?

Customer
My lawyer talked to his lawyer about options. I considered selling my half to him but now have changed my mind. Nothing was signed
img

Debra, Expert

If there was nothing in writing then there is no sale.

In almost all cases verbal agreements are binding but that is not the case when it comes to the sale of land.

So if there was no written agreement you are off the hook.

Does that clarify the law?

Please feel free to post back with any follow-up questions you may have. If you don't have any then I hope I have earned a 5 star rating but if you don't feel that I have please don't hesitate to reply back and let me know what more I can do to assist you. Finally, please know that even after you rate me I will be here for you and you can ask follow-up questions if you think of them later on at no further charge of course.

Customer
Even if my intention was to sell to him and I told my lawyer I would and then changed my mind
img

Debra, Expert

Yes as there was no written agreement.

Customer
Even if the lawyer emailed his lawyer and said I would let him buy me out
Customer
His lawyer said I could go to court and the judge would force me to sell to him. Is this true?
img

Debra, Expert

That may be interpreted as an offer in writing.

I just don't think the would win in court but it is possible given this email.

I think you need to get a legal opinion from your own lawyer.

Customer
My lawyer isn't the best and has not given me good legal advice. I have signed nothing and only asked him for advice and selling my half was an option.

Then I think you are fine.
