Expert's Assistant chat
Customer: Our landlord has been promising us for 4 years to replace our out dated base board heaters as our bills are outrageous... what can we do to have him actually do them? We also have a serious mild problem in our windows, I have pictures of us cleaning them that isn’t pretty, they have vegetarian growing between them.
JA: Because laws vary from place to place, can you tell me what state the property is in?
Customer: Mae live in Collingwood Ontario Canada
JA: What are the terms of the lease? Any issues related to maintenance or upkeep?
Customer: We’ve been here for 8 years and he’s promising to update the base board heaters as they are out dated, the fire department even did a walk through two summers ago (they were checking fire alarms) and even said that they needed to be updated and our landlord hasn’t done it yet...
JA: Anything else you want the Lawyer to know before I connect you?
Customer: our lease agreement may be void as we have been here for so long.. the rent just goes up every year and our bills keep going up as well.

I am sorry to hear of this difficult situation.

Did the fire department say that they were dangerous?

Customer
No just that they recommend they be updated.

Any inside on if we have to pay rent during Covid 19 ?? Our landlord is demanding we pay but neither myself or my parent are working and we have two young kids.. but he says he needs our rent as that's his income.. so we are wondering if we have to pay him. We have been but we are now struggling to pay our bills with my partner not working. I've been a stay at home mom for the past 6 years as our oldest son has special needs and it was just easier for me to stay home with him. And now we have a 1 year old. I'm hoping to start working again but I have to wait for the social distancing to be lifted for myself to find a job.

This is a very difficult time for everyone. You don't have the right not to pay the rent. If you don't pay your rent the landlord cannot evict you for nonpayment of rent right now but once things are more back to normal they can. You will owe all that rent.

There is no way to compel the landlord to update the baseboard heaters as they are not dangerous and it is not in your lease that you are entitled to this upgrade.

I do wish I had better news for you.

Please feel free to post back with any follow-up questions you may have.
