Expert's Assistant chat
Customer: hi i just wanna ask, cuz my brother and his wife applied for a car loan october of last year but he only have a international licence and his wife doesn’t have a license but they still got the car. then around almost end of december same year they asked me first if i can be a co-buyer of the car i said no, so they asked me again if they can used my alberta drivers license for their application so i said ok but just the license so i went to the the car dealership and meet with the lady and asked her its just the license right? and she said yes, as soon as they have their alberta license will take your name right away so she asked me to sign something and me without reading it i sign and after that i went home. so after a week which is january 6/2020 i received a text from the same lady asking for my bank info so it turns out that i become a co-buyer of the car and the paper i sign is a bill of sale, so during that time i didn’t gave my bank info so january 11 i got approved by the bank where they applied the loan even without my bank info. and now my brother can pay the car cuz he doesn’t have a job and the bank is taking the car back and my credit line is in the line what should i do?
JA: The Lawyer can help you determine if that's legal. Before I connect you, is there anything else you'd like the Lawyer to know?
Customer: they already have the car that time i sign that paper so for me they just really need my license or something

I am sorry to hear this.

What province are you in and what is your brother's explanation as to how this happened?

Customer
im in alberta canada, actually i asked them why you need may license and she said for the their file cuz im now a part of the loan. i mean isn’t it BS making me sign something then ask for a bank info after a week? even in my own transaction of my car they asked for my bank information before asking me sign and just like that im part of the loan that i dont want.

I suggest that you tell your brother that you are not liable for this debt and that what happened to you is tantamount to fraud and if they allow the car loan to go into default you are going to sue them.

This is entirely their fault as well as a fault of the dealer and you were tricked but at the same time I'm not sure the court is going to believe you when you signed documents and said that you didn't read them. That is not a lawful excuse.

Perhaps your best approach is actually to have a lawyer send a letter to your brother.

What you can do to find a lawyer is one of the following things.

You can contact the Law Society and use their Lawyer Referral Service. You will be given the name of a lawyer and can consult with the lawyer and the first half hour will be free.

The number is:

1-***-***-**** or
***-***-**** in Calgary

Or you can check on a site called lexpert. This is a legal directory of leading lawyers and law firms throughout Canada and is well-respected by the legal community.

Here's the link to their website:

http://www.lexpert.ca/directory/find-lawyers-or-law-firms/

Does that help as a starting point?

Please feel free to post back with any follow-up questions you may have. If you don't have any then I hope I have earned a 5 star rating but if you don't feel that I have please don't hesitate to reply back and let me know what more I can do to assist you. Finally, please know that even after you rate me I will be here for you and you can ask follow-up questions if you think of them later on at no further charge of course.
