I am sorry to hear of this very sad situation. Unfortunately, you cannot remove the children from the jurisdiction without the other parent/s consent or else a court order. If you do that it is considered parental abduction.

If that happens the father will be able to apply to the court on an emergency, ex parte, (without notice to you) basis and get an order for interim sole custody. Then the authorities will assist him in bringing the children.

So your very best next step, without any doubt, should be to retain a family lawyer in Saskatchewan.

Do you see what I mean?

Please feel free to post back with any follow-up questions you may have. If you don't have any then I hope I have earned a 5 star rating but if you don't feel that I have please don't hesitate to reply back and let me know what more I can do to assist you. Finally, please know that even after you rate me I will be here for you and you can ask follow-up questions if you think of them later on at no further charge of course.

Customer
He Aments that he is not great with kids and he did sign a paper aauj g that I can take the kids to BC fora visit but did not sign what day or moths that I have to be back
img

Debra, Expert

But if he figures out you are not coming back he can definitely apply for that order. It will hurt you and the kids.

Customer
He knows that I really want to me back near my family
Customer
We have no families in Saskatchewan

But it's not about you. It's about what is best for your kids. You will have to prove that your moving the away from their father is in the best interests. It's not easy to do.

Customer
I was a verbally abused by him and Jasmine was too

You don't have to convince me. I am a single mother of 4 kids. I fully understand and totally believe you.

But I am explaining the law and how a court will look at it.

Customer
Oh okay
Customer
What would you recommend

Debra, Expert

I recommend that you retain a family lawyer in Sask in the city where you were living at once.

Customer
I am in Vernon BC

But the court in BC doesn't have jurisdiction over the children. They habitually reside in Sask.

Customer
My legal Aid said that I could file it here
Customer
I Kyle Wright give Evangelina Wright permission to have full custody of both Jasmine and Summer Wright, during the course of our separation.

Debra, Expert

Well legal aid is a service that provides funding if you are low income but they can't make decisions about the law and I would be shocked if a court in BC would assume jurisdiction over your children.

Customer
i am going to school full the fall
, i am finishing off GED
, Kyle cannot keep a job for a long perid of time, he has had over 10 time in the last 3 years that i have known him

That will be some evidence that you will use for sure.
