Customer: I ordered a kitchen cabinet from a kitchen company but now they wanted to charge extra $100.00 delivery fee which already included in the agreement we signed . The lady we spoke to said if we don't need their installation then $700 dollars will be deducted from the total amount.

Hello! My name is Debra (formerly known as Legal Ease). Thank you for your question. I'm reviewing it now, and will post back again shortly.

I am sorry to hear that this is happened to you.

What province are you in please?

Customer
The contract we signed should include the delivery charge. When we told them that we don't need them to install the kitchen ( installation fee $700) they said they have to charge an additional $100.00 delivery fee .
img

Debra, Expert

In the contact you to agree to the installation fee?

Customer
the lady also said if you don't want to install it then deduct $700.00 dollars from the total amount so they wrote $1900.00 on the agreement yesterday. Total is 3000.00 (cabinet $2300.00, installation $700.) We paid $500 as deposit
Customer
$3000-$500 - $700 = $1800
Customer
because we don't need the installation so they said installation & delivery is total $700.00 so we need to pay $100.00 extra

I suggest you tell this woman that you have spoken with a lawyer and the lawyer has confirmed that they are in breach of their contact.

Tell her that you require them to adhere to the terms of the contract strictly just as they would require you to do.

Tell them if they fail to do so you are happy to have a court decide.

Now the truth is you cannot sue for $100 even when there is no pandemic but I doubt they know that.

If that doesn't work you can either refuse the product and sue for the deposit back or agree to pay and then report them to the Better Business Bureau.

Does that help?

Please feel free to post back with any follow-up questions you may have. If you don't have any then I hope I have earned a 5 star rating but if you don't feel that I have please don't hesitate to reply back and let me know what more I can do to assist you. Finally, please know that even after you rate me I will be here for you and you can ask follow-up questions if you think of them later on at no further charge of course.

Customer
Right now because of the COVID -19, everything almost shuts down even the court. I found out a way to complain about business in Ontario but I need to send a complaint letter to the first. I will try your way first and talk to them today. Thanks
img

Debra, Expert

You certainly can't sue you in small claims court now. But you will be able to do in a while. Nothing is immediate anyway and you wouldn't have this resolved for close to a year even if there was no crisis.

Customer
this is why they behave like this. Many people bully people's rights because they know you are not going to file it to the court ... time & money not worth so they tricked you and they know you wanted it soon
Customer
I meant you wanted your kitchen

Debra, Expert

Exactly.

But the BBB will harm their reputation and they will care.

You can also give them a bad rating on HomeStar if they are on there.

Customer
I only see google review has not to search BBB or Homestar yet. Several contractors referred this company to us so we trust the contractors
Customer
anyway, i am going to write it to them today. give a try . thanks

You are very welcome.

Please be sure to rate me before you leave the site so that I can receive credit for my work.

Thanks and take good care.

Customer
Hi Debra, I texted them and they agreed to $1800 now not charging 100 dollars more when i asked their business registration number and etc. the next step is they are asking to send e-transfer but my family would prefer bank draft hand it to the delivery guy when it comes. What are your suggestions?
img

Debra, Expert

That is great news.

I don't think that you can get a bank draft now.

I think you should ask for the e-transfer right now.

Customer
it is great news . ok thanks for your help today.
Customer
Can i ask you another case i have ?

Debra, Expert

And, to be sure that I am the one answering please state "this is only for Debra" and if any other expert answers you just opt them out.

Here is what happened chronologically:1. In January 2018, I was planning to change to another bank for my house mortgage. ***** *****aw , my mom's friend said he can help me.2. Kent asked me to retain a real estate lawyer and his lawyer discovered there was a lien on my property and i was unaware at that time. Therefore, Kent suggests I need to pay off the owing from CRA first then change another bank that offers better interest rates and terms.3. Kent suggested we get a fast 2nd position private mortgage, but keep it as a secret to the current bank.4. Kent increased the lender/broker fee to $3000.00 just half-hour before we were going to sign the commitment. He said lender asked $1000.00 more5. In Feb or March 2018, we signed this commitment in Joseph Chan's Law office. His assistant Christopher (law student) didn't explain it to me and just asked to sign it.6. In Joesph Chan 's law office, When they were contacting CRA to pay the debt, they realized my former accountant made the mistake. Therefore, CRA registered a wrong lien on my property. In fact, I didn't owe CRA $ 70000.00. ( I was having flu caught from someone i worked with )7. When i went to BO Hou Law office, last year to change to another lender ( failed to do last time due to the CRA issue and credit damaged) . Bo's assistant received my commitment from Joseph Chan's office and told me the mortgage broker was not ***** *****aw on the paper, and I was shocked.8. In the meantime, another broker told me that i should ask my first lender to refinance the property instead of signing a much higher interest rate private mortgage with kent if the value of the house has increased. Howeve, Kent didn't tell me there was another option i should consider first.9. I checked Kent's broker license online and his company name is ***** ***** mortgage associates inc. However, He insisted he is the broker from the broker financial group when we met again last year.

this is the message from our charted accountant James Xie :
Background:
Yolanda operated a gift shop in a shopping mall in Greater Toronto Area as a sole proprietor. She sub-leased a small area from a retail store. The retail store was closed in 2008/2009, and Yolanda was thus out of business, the accountant was aware of all these changes.- The accountant failed to close the HST account, and did not communicate with Yolanda about the status of her HST account. This led to multiple arbitrary assessments from CRA. Subsequently, collection actions was enforced, lien was imposed on Yolanda's personal property, and her bank accounts were seized.- Another major mistake is that in 2014, an HST return related to Yolanda's corporation was filed twice by mistake. One was filed under Yolanda's corporation and the other one under Yolanda's sole proprietor HST account that should have been closed years ago, which resulted in double taxation. It took months for Yolanda and the successor accountant to explain and prove to the CRA, and to have the 2014 HST return amended.James Xie , CPA, CA, MMPA, LPA
