Customer: I live in Alberta and own a leasehold condo unit in Vancouver in which my son resides. The building manager has a key.She sent me an email Sunday advising she would enter the unit tomorrow to inspect renovations. She’s aware of the work done, I reminded her in my response. I indicated my son and I would be able to meet this coming Thursday or Friday (I would call). I didn’t receive a reply. My son just sent me a picture, she taped her email to the outside of the door. She shares information about us with residents.Security cameras are located in the lobby of the building and she has been making comments she can see my son does his laundry late at night, the machines are accessible 24 hours a day.QuestionsIs it mandatory for the building manager to have the key ?Does the building manager have the right to post a note, enter the unit when she wishes, especially given we are willing to meet? The email posted on the outside of the door is showing my email address, is this a breach of my personal info ?Is the building manager bound to keep all matters confidential? The camera in the lobby is meant for security purposes, is monitoring people’s activities breaching privacy ? My son and his partner are fully aware she is along with help from a few other residents monitoring when he comes and goes.
JA: We keep all your personally identifiable information confidential and even have people that double check to make sure something doesn't slip through. Your question goes out to the Lawyer and then gets published with the answer to help others with similar problems. Have you talked to an Alberta lawyer about this?
Customer: I haven't spoke to an Alberta lawyer
JA: What steps have you taken so far?
Customer: Searched for breach of privacy litterature
JA: Anything else you want the Lawyer to know before I connect you?
Customer: I can't think of anything else right now

This building manager doesn't know her place. She works for the board. She has no authority except what is delegated to her from the board. You helped elect the board. You are one of the owners. She's employed by the corporation which you are one of the shareholders.

She owes all of the owners and tenants a duty of care. She is overstepping her bounds and acting entirely inappropriately.

While it is important that the condo corporation had someone who has the key in case there's emergency but she is abusing her position and has no right to enter your premises when there is not an emergency when you've told her she may not do so. In fact you can tell her that this is trespassing.

She also has no business stocking your son and his partner.

I suggest that you consider retaining a lawyer to send a very harshly worded letter to the board.

What you can do to find a lawyer is one of the following things.

You can contact the Law Society and use their Lawyer Referral Service. You will be given the name of a lawyer and can consult with the lawyer and the first half hour will be free.

The number is:

1-***-***-**** or
***-***-**** in Calgary

Or you can check on a site called lexpert. This is a legal directory of leading lawyers and law firms throughout Canada and is well-respected by the legal community.

Here's the link to their website:

Does that help as a starting point?

Please feel free to post back with any follow-up questions you may have. If you don't have any then I hope I have earned a 5 star rating but if you don't feel that I have please don't hesitate to reply back and let me know what more I can do to assist you. Finally, please know that even after you rate me I will be here for you and you can ask follow-up questions if you think of them later on at no further charge of course.

Thank you so much for the information Debra, yes it does help as a starting point. Just wanted to mention the condo is "leasehold" versus "strata" units so there's no board per say. Do the same principles apply with leasehold units. As well, how much am I being charged ?

Who hired the manager?

Customer
The building is owned by a company, do you know how leaseholds work ? I'm not familiar. By the looks of it she is getting support from the owner.

Honestly I don't know how that works.

But if you own your unit and lease the land then you should review the lease to see if you agree to it.

Customer
It's a 75 unit building, Vancouver has several like this. I'll contact a lawyer from the site you sent.
Thank you Debra
Customer
I meant from the agency you mentioned
