Customer: I``m Frank;a retired senior citizen for the past 7 years.Recently after my dad passed away, the will stated to sell the house, therefore I had to move from the home that I found in Ottawa back in the 1970s.My brother was very helpful, and found me an apartment. At move in I was aware that this was an old bldg;only 3 story,s with very thin walls, and the street traffic can be heard inside the apt. I have been living there now for the past 17 mts. I moved in August 1st,2018 By the end of Sept;I was calling my landlord, super, owner manager of this apt bldg, complaining of ongoing, persistent, directed noise harassment from the tenant above me,on a daily basis, could be any hour in AM,PM during the night, which is very obsetting and was starting to effect me physically, socially, therefore under the signed Tenancy Agreement;Number 14(C) NOISE That no tenant shall not cause, permit or suffer any noise or interference, which is disturbing to the comfort or reasonable enjoyment of the rented premises by landlord or any other tenant or guest of tenant. Therefore I have called managt many times, have submitted 7 complaint reports, have knocked on the door of the tenant above me who is harassing me on a daily basis, has never opened his door to confront me,have had several impromptu hallway meeting with managt;still no concrete feedback, this tenants pattern of social behaviour towards me is very offensive inhumaine without just cause to inflict his sick torture at at his will, 24/7 I will stop now for your initial response. My email add is:***@******.*** Thanks.
JA: Because laws vary from place to place, can you tell me what state this is in?
Customer: Ottawa,Ontario, Canada.
JA: What are the terms of the lease? Any issues related to maintenance or upkeep?
Customer: The leased apt is now considered on a monthly rental basis; management was negelent during late Sept;Ontario, Ottawa heave snow storm caused hydro outage and most of the apt bldg was completely in the dark, the emergency lighting did not function, there are other maintance issues that happen without notifying anyone before hand,my move in apt was a dirty mess except for the hardwood flooring, kitchen dirty, bathroom dirty, walls could have freshly painted, look old, lighting old etc etc
JA: Anything else you want the Lawyer to know before I connect you?
Customer: For the past 40 years I have worked in 2 different hospitals, on a daily basis I worked to deliver health care along with the health care team, since my forced retirement all I want to do now is rest my werry bones and congratulate myself of a job done well and retire in a restfull respected place.
