JA: What state are you in? It matters because laws vary by location.
Customer: Brantford Ontario
JA: What steps have you taken so far?
Customer: Asked her to leave. Then had to call 911 cause she broke in
JA: Anything else you want the Lawyer to know before I connect you?
Customer: She was just released from jail in March for a machete attack on a girl

I am sorry to hear of this difficult situation.

What is your specific legal question?
Customer
How do I go about getting her out of my house
img

Debra, Expert

Does she share a bathroom or kitchen with you? Do you mean she just got out of jail now for attacking that person? Or did she get up jail in March?

Customer
She got out of jail in March. Was living with a guy while I looked after her dog. Then in Sept. She moved into a room in my house , was supposed to be temporarily. Yes shares kitchen and bathroom
Customer
Never had her sign a lease as it was supposed to be temporary till she found a place

Did the police tell you that you had to let her into the home?

Customer
Hi
Customer
Said I had to go through landlord and tenant

Debra, Expert

They are entirely ignorant of the law. You are not covered by the residential tenancies act and cannot go to the landlord and tenant board even if you wanted to.

You can change the locks at once and you can tell the police that you received legal information that because this is a shared accommodation you cannot go to the landlord tenant board as they do not have jurisdiction over you or you would already have gone.

If that doesn't work you can have a lawyer sent her a letter threatening a lawsuit and if that doesn't work then you would have to have a lawyer lawyer seek an order for possession.

Does that clarify the law?

Please feel free to post back with any follow-up questions you may have. If you don't have any then I hope I have earned a 5 star rating but if you don't feel that I have please don't hesitate to reply back and let me know what more I can do to assist you. Finally, please know that even after you rate me I will be here for you and you can ask follow-up questions if you think of them later on at no further charge of course.
