Customer: I was recently a Respondent in an Interim Without Prejudice Vary Parenting Order last Tuesday December 10, 2019. I am the legal guardian of my two grandsons ages 9 and 10. Their father is the Applicant and has been in prison and has served his term and is now out of prison trying to get greater access to the children. He now has numerous criminal charges against him with upcoming trial dates in March as well as June in Grande Prairie, Alberta. The judge who sat on December 10, 2019 was not familiar with the case and had not thoroughly read the file. My oldest grandson age 10 has been seen and diagnosed by a psychiatrist with emotional disorders. My grandson sees the psychiatrist every 3 months and as well he sees a psychologist for counselling every 2 weeks. The father of the children does not understand the psychological condition of the child and was begging the judge to allow the children to be assigned a lawyer in this case. The judge finally consented without even reading the file that had the psychiatrist report in it. I am concerned for the effect that involving the children will have on them by being interviewed by a lawyer. I wish to have the children as far removed from the legal proceedings as possible to preserve their innocence and reduce any further stress on a child that already suffers from emotional disorders. Please advise as to how I need to handle the appeal.

Customer: The next parenting order court appearance is scheduled for January 21, 2020. The appeal is scheduled for the Queens bench court January 20, 2020.

I think the laws vary from province to province so any chance of getting advice from an attorney in Alberta?

There are no lawyers from Alberta on this site.

I can suggest how to find one for a face to face consultation if you like.

I have to leave for a meeting now but will check back when I return.
