Customer: We put up a hanging basket two years ago when we moved in. It was on the end of the kitchen cupboards and holds vegetables. We have undergone numerous inspections by the owners agent and until last week there was no problem. Now the owner wants the baskets removed and the cupboard replaced rather than just repairing the holes. The cupboard is part of a wall unit that would have to be destroyed or entirely replaced at great expence. We are threatened with eviction if we do not replace the cupboard and think this request is unreasonable? Please advise!

Customer: We have no lease only a rental agreement

Customer: According to the agreement we are not to screw or attach anything to the unit, we are however allowed to hang pictures and wall hangings. Replacing the cupboard is unreasonable as it has been up for two years and a reasonable repair can be made1

Did you tell them you can fill the wholes and make the cupboard look as good as it did before?

Did you ask why they are dealing with this now after two years of allowing it?

I suggest that you tell the property manager that you will not be replacing the cupboard. That is unreasonable.

You can tell them that when you finally move out you will remove the basket and then will ensure that the cupboard looks the same as when you moved in.

You can tell the property manager that you know full well that this is not grounds for eviction and you will contests any attempt to evict you.

You would have to be served with a notice of eviction which you could ignore. Then the landlord will have to get an order for eviction and they won't be able to do that because you will have a hearing and will fight them. This is not grounds for eviction.
