Customer: Despite a restraining order on his ex-wife (Laurie) and grand kids (restraining order is of an undetermined time - 2 meters away - directly or indirectly - anywhere ), against him, a neighbor (who just move in a year ago in the next unit to live with Cathy an ex-friend of us) keeps on harassing Dave, the man Laurie (ex wife) is living with for over 5 years (minimum that I know of) and I (since I am their friend). The police came after he made a complaint about some false allegation to the effect soap was spread on his plants while Dave was washing his truck. The police told Dave he should move. What about the restraining order?
JA: Was a restraining order issued? What were the basic terms?
Customer: Signed by the judge - Section 46 Family Law Act
JA: Is there ongoing abuse or harassment? Were the police called?
Customer: There is on going harassment BUT he is squeezing it ''within'' the law. For example loud music but not after 11 pm.
JA: Anything else you want the Lawyer to know before I connect you?
Customer: He got his son and girlfriend son to harass Laurie. Her son's girlfriend called her (they were not in touch for a year) and told her to come and pick up her son's childhood stuff and then they both went on sending her nasty messages on the cell phone.

Basically, a person with a restraining order is harrassing while keeping it ''within the limit of the law'' believing that he can go away with it (and so far, he did). Example - will put very loud music but between 8am and 11h pm (so the police will do nothing). I, for my part, believe that the restraining order should be taken into consideration in such a situation but the police did not even want to look at it and actually told Laurie (his ex-wife has the restraining order against him - Family Law Act, section 46) she should move!!! (She's been living here for 4 years - he moved next door a few months ago in the unit occupied by a woman to live with her). (the story is long but this is in a nutshell).

The authorities are unlikely to help you with this. A family law restraining order isn't usually considered a "big deal" by the police. They'll enforce such orders issued by the criminal court.

You need a civil lawyer to write a letter to them threatening to sue them for their interference with your use of your property, and threaten an injunction which actually has some penalties and some teeth. If you've used a lawyer before then contact them to discuss this.
