Customer: is this for canadian family court
JA: What steps have been taken? Have any papers been filed in Canadian family court?
Customer: Not yet. I need to know what papers I need to fill out. My ex had my daughter taken away she is temporarily staying with the grandmother. I was told by Child services I need a court order to take my daughter
JA: Have you talked to a lawyer about this yet?
Customer: not yet I don't have the funds to obtain a lawyer. I am waiting on legal aid but it will take along time
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: My ex has spoken to my sister and wants to sign over guardianship to her as my sister is stable with a home . The only issue is she is in Nova Scotia. My ex's mom put my ex in foster care as she couldn't parent I don't think my daughter should be with someone who couldn't raise there own kid. My ex has run away many times with my daughter but courts always went in favor of her due to her having a mental issue. I'm worried for my daughter

Hi there, without knowing more, I can only answer generally but I hope it is helpful:

You will need to apply for a custody order from the court, if a custody order is already issued, you need to apply for a change in the custody situation by claiming there is a fundamental change in circumstances.

I understand legal issues may be frustrating, but I hope I was able to provide a little clarity here.

Thank you for trusting us here at JustAnswer. If you have a new question in the future and would like to engage me again, please do not hesitate to request for me directly by typing - "This is only for JC" and I will get to you as soon as possible!
