Hi and thank you for using Just Answer.  My name is***** will be assisting you with your question.

Just a general disclaimer that this conversation is for informational purposes only. I am a licensed Canadian lawyer; however, you would need to retain a lawyer to take any legal action and/or preserve any of your legal rights. I may be away from my desk from time to time, but rest assured I will always return back as soon as possible.

Can you describe the circumstances more precisely?  Where you were?  What happened leading up to this encounter? Did he have a weapon?  Did you contact the police?  Thanks.

Customer
Him and his daughter claimbed thru my bdrm window just after midnight. He is homeless. He started yelling at me. I then went to bed. I got up and got my teenaged son ready for school. I drove my son to the bus. I came home and my ex and his daughter were walking. And he tried to signal me to stop. I stoped and he went to reach his hand in my car and i drove off. He claims thst i ran him over
Customer

You should qualify for a protection order.  Contact  VictimLinkBC at 1-***-***-**** or email *****@******.*** first thing Monday and they will tell you if you qualify and the process you must follow to obtain the order.

Customer
Ok. I just called the RCMP to request a restraining order

That may work, but generally, your ex would have had to have been arrested for some domestic violence related crime.  The trespass/break and enter may suffice.

I hope this helps and you get the protrection you need.  Good luck.

Customer
Last year he was arrested for domestic violence. He us on probation. I made a statement earlier this year. He has conditions he is suppised to follow. One condition is thst he can be here if i say but if i ask him to leave he must do so.

I would amend that condition to no contact at all and if he violates that provision, that is, in and of itself, a criminal offence.  My opinion, but you should not be made to live as you have been recently.  I am happy to provide answers to any follow-up legal questions.

Customer
Wonderful. I have a restraining order
