The home you're in is the Matrimonial Home. Even though he's solely on title, by merit of being married you each have equal possessory rights. So he can't simply evict you. I'm sure he's been told this.

If the marriage is well and truly over, then it's time to look at the finances. If, when you divide the wealth you have accumulated while together, and with child and/or spousal support, if you think you could swing it to buy out his share of the home then it's time to work out those details.

If there's no way you could do that, it's time to start looking for another place to live and co-operating to sell the home while the market is still hot.

A good family law lawyer should be able to help you get started. Ask family and friends for a recommendation, or try the provincial Law Society website for a referral service, or try lexpert.ca to find professionals near you by their specialty.

I'm here if there's more to discuss on the topic.

And in my experience, if a many accuses the wife of cheating as the reason why he wants to end the marriage and the wife isn't cheating, the husband usually is cheating and he's trying to make the wife feel like it's her fault that the marriage has ended.
